Judge Grants Mauro Icardi Exemption From Arrest in Injury Case

Mauro Icardi Exemption Granted

Mauro Icardi secured a legal exemption from potential arrest following a formal petition filed by his defense attorney Francisco Oneto, according to Infobae.

The ruling issued by Tigre Guarantee Judge Orlando Abel Díaz does not close the ongoing penal investigation into allegations of aggravated minor injuries brought against the player by his ex-partner Wanda Nara.

Tigre Court Evaluation

Judge Díaz based his decision on articles 89, 92, and 80 of the Argentine Penal Code, noting that the alleged offense carries a prison sentence ranging from six months to two years.

Under the terms of the resolution, the court granted the exemption under a sworn pledge known as a caución juratoria, which legally binds the defendant to cooperate with the ongoing judicial process. Icardi must personally appear before the court within five days to formalize the benefit or risk revocation.

Nordelta Incident Investigation

The underlying criminal case stems from an emergency call placed on Friday, November 6, 2026, to the 911 dispatch from Icardi’s residence in the La Isla private neighborhood of Nordelta, as detailed in police reports cited by Infobae. Officers from the Tigre Patrol Command arrived at the scene and interviewed Wanda Nara, who stated that her 11-year-old daughter Francesca had been locked in a room.

According to the police report, the minor communicated via WhatsApp from a computer to ask for help, stating she was frightened and that her father had struck her. The incident drew a police response that included multiple patrol cars and an ambulance, with the confrontation forcing Wanda Nara to suspend her work recording MasterChef Celebrity at Telefe studios in Martínez. The situation escalated into a shouting match between the adults out in the neighborhood, during which Wanda Nara directed verbal abuse at María Eugenia “la China” Suárez, shouting Mala persona, en un par de años sos vos while Suárez attempted to calm the situation.

Martín Migueles also tried to intervene to concil the dispute without success. A photograph captured during the tense afternoon showed Suárez and Migueles seated on the lawn with Isabella Icardi, as the actress explained something to the child while Migueles listened.

Afterward, Nara left the property in an ambulance accompanied by her two daughters before heading to a police station to file the formal complaint. Prosecutor Julio Petrucci also ordered a medical-legal recognition of Francesca at the Dique Luján hospital to check for any injuries.

Icardi Faces Restrictions on Contacting His Daughter

The exemption ruling follows a separate precautionary measure issued a day earlier, which imposed a 45-day restriction prohibiting Icardi from approaching or contacting his daughter Francesca. Diario El Día de La Plata reported that the protective order requires the player to maintain a distance of more than 100 meters from the child and at least 300 meters from her residence or any location she frequents.

In addition, the injunction explicitly forbids any form of communication via telephone calls, text messages, social media, or third-party intermediaries. Prosecutor Julio Petrucci of the Tigre Gender Violence Functional Instruction Unit continues to oversee the investigation, which includes collecting testimony, reviewing electronic devices, and conducting a medical-legal evaluation of the minor.
