In trouble for a baseball bat and a taser, but they were a toy and a fly-killer

Viterbo – (sil.co.) – On trial for a baseball bat and a taser found by the carabinieri in the trunk of the partner’s car.

It happened to a man from Viterbo, defended by the lawyer Remigio Sicilia, who obtained the go-ahead from judge Ilaria Inghilleri for the abbreviated procedure conditional on hearing the woman who in the meantime had become a former partner of the accused, called to answer for the illegal possession of objects suitable for to offend.

It was the same woman who explained that it would only be a toy and a light bulb, before the alleged crimes were examined by the same magistrate in the courtroom, where in the meantime they had been “delivered” by the appropriate office of the building of justice.

“We were stopped by the carabinieri for a check on August 1, 2019, while we were going shopping at the supermarket, as soon as we unloaded our luggage after returning from vacation”, explained the woman, mother of five children, two of whom were on vacation with the couple.

The toy baseball bat had been left in the trunk in our haste, while the other toys, all of which were in a bag, we’d already brought home. The alleged ‘taser’, on the other hand, we bought for a light bulb at 12-13 euros from the Chinese, later discovering that it also served as a fly-killer, like plastic rackets. They don’t even kill flies, let alone if it could hurt a Christian,” the woman explained.

Having examined the evidence, the prosecutor himself, despite the baseball bat not being made of plastic but made of wood, even if much shorter than the standard and made of light wood, expressed himself in favor of acquittal, acknowledging the minor of the fact.

Attorney Sicilia, for his part, asked for acquittal with the broadest formula, because the actual fact does not exist.

The judge, for economy of the role, postponed for the council chamber and the sentence.


Presumption of innocence

In the Italian penal system, the presumption of innocence applies until the final sentence. Presumption of innocence which is based on article 27 of the Italian constitution according to which a person “is not considered guilty until final conviction”.
