The Prosecutor’s Office of the Principality of Asturias requests sentences totaling 16 years and 4 months in prison, among others, for a 39-year-old judo teacher from Oviedo accused of continuously sexually assaulting three of his students. The events occurred during the first months of 2023, when the girls were 16 years old.
As stated in the prosecutor’s brief, the accused took advantage of his status as the girls’ coach to establish with them “a close and different bond” than the one he maintained with the rest of the students. Trust also translated into personal treatment on social networks, as he added them to a WhatsApp group through which he organized recreational activities outside of strictly sports, such as bicycle routes or trips to the beach. Once he had gained his trust, the accused began to habitually divert the conversations he had with the three minors to sexual topics that were “totally inappropriate and far from any educational or didactic purpose.” In that atmosphere of “relaxation, trust and camaraderie”, taking advantage of his status as a monitor and the age difference, “in addition to directing expressions of clear sexual significance to them, he lavished abundant gestures of affection on them, such as kisses and hugs, outside of the socially acceptable limits.
The accused always used the van he owned to go on excursions or leisure activities with the minors that he himself programmed. During the first days of January 2023, the accused took the three students to Gijón. During the journey, “with a libidinous spirit”, he touched one of them. Upon his return to Oviedo, the accused took two of the minors to his home and, once there, he showed them sexual objects and engaged in inappropriate behavior with them.
This situation was repeated days later with one of the girls, whom he took home under pretexts related to judo. With the same minor, a few days later, after the accused taught classes at a school in Oviedo, he behaved in the same way again. “The accused took advantage of the training sessions of the three minors to satisfy his sexual instincts,” according to the Prosecutor’s Office document.
The document of provisional conclusions of the Prosecutor’s Office of the Principality of Asturias has already been presented in the Court of Instruction number 4 of Oviedo. The mothers of two of the little girls filed a complaint on March 15 and 17, 2023, respectively. The father of the third reported the events on March 16, 2023. The Prosecutor’s Office considers that the events reported constitute three continuous crimes of sexual assault on minors under 16 years of age with a prevailing situation of superiority. Based on these charges, the public ministry is asking for 6 years in prison for the judo teacher for the events involving one of the victims and five years and two months for each of the other two. In addition, the Prosecutor’s Office requests a total of 31,000 euros in compensation for moral damages and restraining orders from the man with respect to the little girls.
