The end of the insolvency proceedings against Boris Becker comes as a surprise. The former tennis star pays what he considers a measly portion of the debt to the insolvency administrator and is fine. Becker expert Daniel Müksch explains how the deal should be assessed and why both sides agreed.

What does the end of the insolvency proceedings mean for Boris Becker?

For Boris Becker, the deal means that his insolvency proceedings in England are over. The process would actually have continued until 2031. The whole thing was made possible by a regulation in British insolvency law: it’s called “discharge from bankruptcy” and is intended to give those involved a financial fresh start in Great Britain.

However, there are still restrictions for him in Great Britain: Becker is still not allowed to work as a managing director in England, and he also has extended conditions for loans from banks. These restrictions apply until October 16, 2031, the originally planned end of his personal bankruptcy.

Why did Boris Becker pay 450,000 euros to the insolvency administrator?

For Boris Becker it is the opportunity to finally close the chapter of personal insolvency. He then largely leaves the topic off the table. What should not be ignored, however, is that it has nothing to do with his suspended sentence. This will continue until the end of the year. This makes it difficult or even impossible for him to enter many countries. Such as in Australia, the USA or of course Great Britain.

Why could the insolvency administrator have agreed to the deal with Becker?

This gives the insolvency administrator a chance to at least get some money. Although 450,000 euros initially sounds relatively large, compared to the total amount owed by creditors, the current one-off payment is meager. However, it would have been very difficult for the insolvency administrator to get Boris’s money. He would have had to work very closely with the authorities, for example or in Italy (where Boris currently lives). He would have had to apply for administrative assistance and lengthy international proceedings would have been initiated. The saying: “It’s better to have a sparrow in your hand than a pigeon on a roof” probably applies best here.

It’s the easiest solution for him to end the chapter like that, and of course it makes sense from his point of view. He has good jobs again as a testimonial and as a TV expert and the €450,000 shouldn’t hurt him much. But morally I see problems here. Boris Becker has once again chosen the easiest solution for him. Just take it – he would have said: A court has found legitimate claims against me. I want to settle these claims and pay everything back so that I can be at peace with myself again.

But he didn’t do that. One must not forget: He does not pay by far the largest part of the claims against him. He has only been released from prison because there is a program with which the British justice system wants to relieve the overcrowded prisons on the island. All in all, not very gentlemanly, I have to say.
