Prosecutors Move to Dismiss Charges Against Quarterback’s Brother Accused of Assault

The quarterback’s brother was accused of grabbing a woman by the neck and forcibly kissing her, and shoving a waiter in an incident last February

Prosecutors in Kansas are asking a judge to dismiss three criminal charges related to allegations that Jackson Mahomes –younger brother of the quarterback of the Kansas City Chiefs, Patrick Mahomes— grabbed a woman by the neck and kissed her against her will.

The assistant district attorney of Johnson County, Megan Ahsens, filed an action Tuesday to dismiss three counts of aggravated sexual assault. A fourth charge — misdemeanor assault — would remain.

The legal action cited the alleged victim’s lack of cooperation.

The lawyer of Jackson Mahomes, Brandan Daviessaid in a statement that his client “has done nothing wrong. We have full confidence that the truth of the matter will be revealed in the end.”

The original charges accused Jackson Mahomesa 23-year-old social media influencer, of crimes that occurred on February 25 at the Aspens Restaurant and Lounge in Overland Park, Kansas, a suburb of Kansas City.

Researchers pointed out that Mahomes He pushed a waiter who tried to enter a room where he was with the owner of the restaurant, Aspen Vaughn. After the waiter left, Mahomes I take Vaughn down the throat and forcibly kissed her on three separate occasions without her consent, prosecutors alleged.

Vaughn told the police that Mahomes was a friend of his stepdaughter, and that he had caused problems and been asked to leave the restaurant in the past.

Vaughn He closed the restaurant in August, saying his business suffered from the publicity associated with the case. She told the Kansas City Star at the time that she received death threats and harassment, and that the restaurant was vandalized following the charges.

Tuesday’s court action noted that prosecutors were presented with an affidavit from attorneys for Vaughn saying that she would refuse to testify. The document states that prosecutors still plan to move forward with the case, noting that surveillance video captured the encounter.

But, the document also said that subpoenas for Vaughnreferred to in court documents by her initials, have not been able to be released.

“In fact, it has become clear to the state, through conversations with more than one person with her, that AR is currently avoiding attempts to be subpoenaed to court,” Ahsens wrote.

The lesser charge of assault remains, because it involves pushing the waiter.

A spokesman for the district attorney’s office declined further comment.
