The judge files Sandro Rosell’s complaint for Operation Catalunya

BarcelonaL’Operació Catalunya gets stuck in the courts again. A Madrid court has dismissed the complaint that former Barça president Sandro Rosell filed against ex-commissioner José Manuel Villarejo for orchestrating a plan to implicate him in a criminal plot that led him to prison, through false evidence, in the framework of the so-called “Operation Catalonia”.

In an interlocutory hearing, forwarded by ‘El Confidencial’ and to which EFE has had access, the 13th District Court of Madrid has agreed to dismiss the complaint, concluding that Rosell’s accusations about “Operation Catalonia” are they are based on unconfirmed information. In his writing, the magistrate maintains that the complaint does not provide “anything” that would allow any imputation to be sustained against Villajero and the other three defendants. Because? According to the resolution, no data is included that “allows profiling” criminal behavior on his part.

For the judge, the complaint contains accusations made “under the guise of a series of subjective assessments” based on facts or data obtained through the media, “but without delimiting any conduct” regarding the defendants.

The magistrate also refuses to investigate what the former president of Barça pointed out in his complaint: that there was a kind of “black list of people related to Catalan independence who should be harmed in any way”. According to the judge, this “beyond” his jurisdiction.

Sources from Rosell’s defense, collected by Efe, have announced that they will file an appeal against the investigating judge’s decision to file the complaint, which is based mainly on several of the audio recordings kept by the former commissioner.

The fate of the rest of the complaints

Rosell sued for crimes of criminal organization, falsification of an official document, false accusation and denunciation, embezzlement of public funds and illegal arrests against Villarejo, two police inspectors and the FBI agent in the ‘Embassy of the United States in Madrid. He promoted these actions following some audios published in The world in which you could hear how the former leader of the PP in Catalonia, Alicia Sánchez-Camacho, suggested to the police that he closely follow the Catalan businessman.

As a result of this complaint, for the first time, a court in Madrid accepted the complaint and different affected parties also considered filing a complaint. It is the former Minister of Economy Jaume Giró and the former president of the Generalitat Artur Mas or the former secretary general of the CDC Oriol Pujol were also thinking about it. After this Tuesday’s decision, we need to see what happens to the rest of the lawsuits: will they also face a new refusal by the courts to investigate the facts?
