District Heating Customers Launch Class Action Lawsuit Against EON and Hansewerk Natur

The morning post from Berlin is the headline.

The demand for additional payment hits Stadtwerke Erkrath’s district heating customers like a slap in the face.

The district heating network has been part of the Erkrath municipal utility since January 1, 2022. However, the network is still leased to EON.

With the class action lawsuit, the Federal Association of Consumer Protection in Berlin (vzbv) wants to demand direct refunds for participating consumers.

According to the vzbv’s assessment, the price increases after 2020 at Eon and Hansewerk Natur are ineffective because the price change clauses, according to which suppliers are allowed to make price adjustments, do not meet the legal requirements.

For this reason, the Federal Cartel Office is also taking a closer look at several suppliers.
District heating customers are basically stuck in a price trap: they are dependent on the respective local supplier. It is not possible to switch to the competition because it does not exist. “District heating suppliers have a monopoly position in their respective network areas”.
The lawsuit was filed by the federal association on behalf of Eon at the Hamm Higher Regional Court. The court will decide whether to “immediately” open this register of claims at the Federal Office of Justice. On the website of the Federal Office of Justice (BfJ), consumers can publicly see which class actions have been filed. You can then join the new type of lawsuit there. Make a note of the date at the beginning of January 2024, then the court should have opened the lawsuit register and the officials in the ministry should have posted the information accordingly.

Free participation in the class action lawsuit

All affected consumers can join the new class action lawsuit and must register in a lawsuit register. After registration, the Federal Office sends everyone a registration confirmation.

If the vzbv wins the class action lawsuit, EON must pay the total amount of all payment claims to a “trustee”. This checks the claims of the registered consumers and transfers the amount to them. The procedure may also initially go to the next instance at the Federal Court of Justice (BGH).
