After the Buenos Aires Justice ordered Boca Juniors to postpone the elections due to a request presented by the Delegation of Argentine Israeli Associations (DAIA) under the argument that Jewish members would not be able to participate due to the religious celebration of Shabbat, the club confirmed the new date of the elections through a statement in X. “We will all celebrate the joy of participating in the great decisions for the good of our beloved Boca Juniors,” they stated.

Although the initial date had been agreed for Saturday, December 2, the resolution of Judge Ricardo Feliz Baldomar, in charge of the Criminal Contravention and Misdemeanor Court No. 22, gave rise to the request made by prosecutor Diego Espada to reschedule the votes. In this way, the judicial authorities established that the selection of the future presidential formula will take place the next day, that is, Sunday, December 3.

Although the sports institution announced that it would comply with the ordinance, in the same statement they considered that there had been “serious irregularities” throughout the process. According to the information provided by the Xeneizes, it all began on November 6 with the DAIA’s request to modify the dates of the elections for Shabbat.

For this reason, the club contacted the General Inspection of Justice, since it is the competent authority to be able to modify the electoral process without violating the general rules and regulations of the same institution. However, the entity’s response indicated that there was not enough time to make the changes, alleging that this type of requests should be submitted with “the due notice provided for in the entity’s statute.”

In this sense, the control authority stressed that the modification would incur a “serious violation” of the statute. In this way, Boca Juniors responded with a refusal to the Jewish community on November 14, which was based on the inspectors’ decision.

In response to the impossibility of changing the date of the elections, they reported that on November 17, five alleged members of the club denounced the institution for “discriminatory acts” in front of Prosecutor’s Office No. 30, headed by prosecutor Diego Espada. Likewise, they indicated that the complaint would have been made through a telephone call and they pointed out against the public official for intervening in the case, even though he did not verify the identities of the subjects and ask them to ratify the complaint.

Although Espada asked the court to modify the date of the vote, it summoned the club authorities to a hearing that was held last Thursday, November 23. At the hearing, the CABJ representative presented a brief to the Prosecutor’s Office and another to the court to complain about the lack of ratification by the complainants, because three of them had denied their participation.

In this way, the Justice ordered the change of the date, indicating that the request is made within the framework of a process that tends to “establish whether the Boca Juniors club incurs discriminatory conduct by establishing the date of the elections for the renewal of authorities next Saturday, December 2, 2023, thus depriving a large group of members of the institution who profess the Jewish religion from being present at the election site to cast the vote…”, well, according to slogan, “…when said elections are held on a Saturday, the date on which Shabbat is celebrated for said community, the circumstance of there being prohibited activities such as traveling in one’s own vehicles or public transportation, carrying out transactions, using the telephone or carrying out any work “, generates a context in which the aforementioned group is prevented from participating in the elections of the club of which they are fans.”
