Violent Assault at Piazzale Vittorio Veneto Raises Questions on Business Suspension

A man approaches the counter and orders, continually taking furtive glances around. A few moments later we understand why: a punitive expedition swoops in, pulls him to the ground and hits him repeatedly with a machete and a baseball bat. Panic breaks out, the bouncer tries to calm things down, but has to give up in front of the commando, then the victim manages to take shelter behind the counter. These are Monday’s gruesome images from the cameras of the kiosk in Piazzale Vittorio Veneto, where a Peruvian customer was seriously injured; an episode which triggered a 30-day suspension from the business by the police commissioner because it was considered to be a habitual meeting place for individuals with a high level of social danger. But the family that owns the business, victims and not causes of the violent climate of the Cascine, is not on board: “This decree leaves us stunned, especially considering the strong collaboration with the police – explains the owner Andrea Giordano –. We are the the first to ask, for years, for the restoration of legality in the Cascine. On the other hand, following yet another episode of unprecedented violence, where we are victims, a decree suspending our license is issued against us. We find it profoundly unfair, disproportionate and short-sighted” . “The rule provided for in art. 100 Tulp is inherited from the twenty years of fascism and lends itself to unfair and arbitrary applications – comments the lawyer Daniele Quaranta –. It is important, therefore, that it finds few and very thoughtful applications, taking into account the concrete circumstances and the actual possibilities of the trader to comply with this provision. In other words, if on the one hand it is legitimate to require private individuals to respect the rules, on the other hand it is not possible to delegate the restoration of legality and public order to private individuals”
