Arrest of teacher accused of rape ordered
The Judiciary also ordered seven months of preventive detention for the accused
The judge of the 4th Preparatory Investigation Court of Paucarpata sub-specialized in Crimes Associated with Violence Against Women and Members of the Family Group of the Superior Court of Justice of Arequipa, Jenny Arias Pérez, ordered preventive detention for 7 months and the corresponding order of capture of the judo teacher, Waldir Curi S., prosecuted for allegedly sexually assaulting a minor under 16 years of age.
The magistrate, after assessing the arguments of the parties at the hearing, concluded that there are serious and well-founded elements of conviction that link the defendant to the commission of the crime of violation of sexual freedom to the detriment of one of his students.
The events allegedly took place in November 2022, when the defendant, together with a delegation of adolescents, arrived in the city of Arequipa to participate in a judo tournament and stayed at a hotel in the Mariano Melgar district.
According to the accusation of the Public Ministry, the defendant subjected the minor in one of the hotel rooms. The case was reported after the victim told the director of the school where she studied about the attack.
The judge concluded that the defendant lacks family, work and home roots that can prove his permanence during the investigations; also, taking into account that the prognosis of a sentence to be imposed is 21 years in prison, which would lead to a risk of flight , the aforementioned coercive measure was ordered.
