Proposed Amnesty Law in World Youth Day May Cover Crimes in Rui Pinto’s Football Leaks Trial

The proposed amnesty law conceived on the occasion of World Youth Day may cover the vast majority of crimes imputed to Rui Pinto in the Football Leaks trial, in view of the order made this Tuesday by the judge.

The activity of the creator of the electronic platform targeted by the Public Ministry (MP) in this case took place between September 2015 and January 2019, when he was arrested in Hungary, then only 30 years old, that is, the age limit provided for in the proposed law for pardon of sentences and amnesty of crimes and infractions that was approved last Friday in general by the parliament and went down to the commission of Constitutional Affairs, Rights, Freedoms and Guarantees.

The order signed by Margarida Alves maintains that Rui Pinto, currently 34 years old, is “covered by the scope of application of the aforementioned Law” due to the age he was at the date of the facts imputed in this process.

Underlining that “some crimes for which Rui Pinto responds in court will be excluded from such amnesty”, namely extortion (in the attempted form) and those that fall under cybercrime, the magistrate pointed to the possible application of the amnesty to the 68 crimes of undue access and to the 14 of violation of correspondence, which together represent 82 of the 90 crimes imputed to the main accused of the process.

Today’s order dictated, due to the issue of the amnesty proposal, the postponement of the reading of the judgment that was scheduled for Thursday (14:00), at the Central Criminal Court of Lisbon. However, the next 31st, at 2:30 pm, has been scheduled, in case the law conceived on the occasion of the World Youth Day enters into force until the 28th, or, alternatively, the 11th of September (2:30 pm), to in case that doesn’t happen.

Lusa tried to get a reaction from Rui Pinto’s defense, but so far this has not been possible.

At issue in the diploma are crimes and offenses committed until June 19 by young people between 16 and 30 years old, to be adopted due to the World Youth Day (WYD), determining a one-year pardon for all sentences of up to eight years in prison .

An amnesty regime is also foreseen for offenses with a maximum applicable fine of up to 1,000 euros and criminal offenses whose penalty does not exceed one year in prison or 120 days of fine.

The proposed law includes exceptions to pardon and amnesty, not benefiting, namely, those who have committed crimes of homicide, infanticide, domestic violence, mistreatment, offense to serious physical integrity, female genital mutilation, offense to qualified physical integrity, marriage forced, kidnapping, against sexual freedom and self-determination, extortion, discrimination and incitement to hatred and violence, influence peddling, money laundering or corruption.

Rui Pinto, 34 years old, was accused of 90 crimes: 68 of undue access, 14 of violation of correspondence, six of illegitimate access, targeting entities such as Sporting, Doyen, the law firm PLMJ, the Portuguese Football Federation ( FPF) and the Attorney General’s Office (PGR), and also for computer sabotage to Sporting’s SAD and for extortion, in the attempted form. This last crime concerns Doyen and was what also led to the pronunciation of lawyer Aníbal Pinto.
