The accusation: The former ultra is said to have conducted the controversial fan choreo on October 30 at the home game against Freiburg. Under a giant pull-up jersey, the north curve ignited blue and white pyrotechnics. When the XXL shirt collapsed after the choreo, the smoke poured out and clouded the arena. Visually strong, but banned because of the toxic smoke. Therefore, Kirstein was charged with attempted dangerous bodily harm.

Chief Public Prosecutor Annette Milk to BILD: “There was an investigation into the initial suspicion of attempted dangerous bodily harm. However, the investigation was discontinued a few days ago. The initial suspicion was based on the fact that it seemed that Mr. K. could have given the start signal for the choreography via radio. He denies that, we can’t prove the opposite to him. On the other hand, vent holes in the foil should ensure that the smoke actually escapes upwards and the spectators are not affected. But that went wrong. For these two reasons, we had to drop the case.”

The stadium ban demanded by the police was also rejected by the club. The supervisory board states: “According to the statutes of FC Schalke 04, the honorary council is responsible in such a situation. He made a decision and imposed no sanctions.” As BILD learned, the result was close.
