Confusion with the posters that prohibit taking photographs and videos of the Camp Nou works

Barcelona “It is prohibited to make and/or distribute photos and videos of the works that have been carried out at the Spotify Camp Nou”, says a sign in Spanish, English and Turkish pasted at various entrances to the Barça venue. The sign, laminated, bears the signature of Limak, the Turkish construction company that is in charge of remodeling the Barça stadium. One of the points where it can be found is at access 18 of the Camp Nou, located at the Travessera de les Corts. ARA has asked official Barça sources about the reasons for this ban and the answer was as follows: “It is prohibited in some areas, basically due to the privacy of the people working on the works and because the club will be leaving distributing images”. But this newspaper has also contacted Limak, who is the one who signs the ban, and the company has given a different version. “This is a communication addressed solely to the construction workers, in no case to the media or to society in general. But in the face of the doubts it may cause, the posters will be removed”, they report after speaking- ne with the club. Therefore, passers-by and the curious will be able to continue portraying the evolution of the work at the Camp Nou.

Can Barça prohibit the works from being recorded?

Anyway, could Barça ban the recording of the works of its facilities? “Yes, Barça can do it,” answers ARA Marta Insúa, president of the intellectual law and image rights section of the Illustrious Bar Association of Barcelona (ICAB) . “For example, for two reasons: because he wants to get an economic return from the works in the form of exclusive making of or to control the information that is published about the works”, he adds.

But Insúa points out that if as a journalist “you are exercising the right to information, and Barça’s works are obviously of informative interest, it is very difficult for the club to tell you anything to record or take photos from outside, because we are talking about works, not a football match, which is protected by intellectual property.” At most, he goes on to explain, “a private individual trying to profit from this content could have problems, but surely the matter would be resolved by the deletion of the images and would not end in a lawsuit.”

An ex-employee of Espai Barça consulted by this newspaper is surprised by Limak’s posters. “It’s the first time I’ve seen it,” he says. On the other hand, another former employee of the most important heritage project in the history of the Blaugrana club explains that “there are people, like some YouTubers, who are making money with the Real Madrid brand by recording videos of the works at the Santiago Bernabéu”. In addition, he says that for clubs, be it Barça, Real Madrid or another, recording images “can be risky from the point of view of safety and health because things can be recorded that are not complying with the appropriate measures “. For the time being, having overcome the mess, it seems that there will be no problem to continue recording images, videos and sounds of the Camp Nou remodeling works.
