This Friday was scheduled for the reading of the judgment in the case in which Rui Pinto is accused of three crimes of illegitimate access (to the computers of Sporting, PLMJ and the Portuguese Football Federation) and four of undue access (Sporting, FPF, PLMJ and PGR), among the 90 that the hacker is accused. But the decision on the trial of the case was postponed, after the court communicated a non-substantial change in the facts of the case, which meant granting time for the defenses to pronounce.
In the session defined for the reading of the judgment, Judge Margarida Alves confirmed what she had already left implicit in the closing of the final arguments and reported the non-substantial change in the facts.The judgment was read on July 13 because there was “a non-substantial change in the facts and legal classification”.
The date of May 26 is reserved in case the defenses understand that it is necessary to hear more witnesses, taking into account these changes, which are not yet known.
Margarida Alves explained that facts change “not in the exact terms of the prosecution” and gave the floor to the defense of Rui Pinto – also representing the defendant Aníbal Pinto, given his absence in court -, who asked for ten days.
“A deadline was requested by the defense and, after deliberation by the court, a period of 10 days was granted to pronounce”said the magistrate.
The collective of judges therefore designated the 26th of May for the eventual production of evidence and the reading of the judgment for the 13th of July.
Rui Pinto, 34 years old, is responsible for a total of 90 crimes: 68 of improper access, 14 of violation of correspondence, six of illegitimate access, targeting entities such as Sporting, Doyen, the law firm PLMJ, the Portuguese Federation of Football (FPF) and the Attorney General’s Office (PGR), and also for computer sabotage to Sporting’s SAD and for extortion, in the attempted form. This last crime concerns Doyen and was what also led to the pronunciation of lawyer Aníbal Pinto.
The creator of Football Leaks has been free since August 7, 2020, “due to his collaboration” with the Judiciary Police (PJ) and his “critical sense”, but is, for security reasons, included in the witness protection at an undisclosed location and under police protection.
