Beaten on car occupants with baseball and golf clubs: Four young men convicted in Salzburg

Several victims brutally maltreated in Strasswalchen. Three-year suspended sentence for 19-year-old main suspect.

The jury trial about an extremely brutal violent attack on four car occupants in Straßwalchen on the night of August 23, 2022 went to the final on Friday. According to the indictment, four young people from the city of Salzburg – a main accused 19-year-old and three friends of his 21, 20) – armed with a baseball bat and a golf club, beat the car occupants. The accused are also said to have kicked and hit the victims with their fists.

One of the victims, all also young men, was hit repeatedly in the face, was unconscious for ten minutes and suffered a number of fractures in the face. According to prosecutor Karin Sperling, the accused also hit their victims’ car massively and damaged it considerably. Background of the incriminated excess of violence: The main accused 19-year-old, he has Turkish roots, wanted to give a man a massive beating in Straßwalchen, with whose sister he has a relationship. However, the later victim, who comes from a Kurdish family, did not agree with this relationship. For this reason, according to prosecutor Sperling, there have been tensions between the 19-year-old main defendant and the girlfriend’s brother for a long time. At the start of the trial on Thursday, RA Robert Morianz, defense attorney for all of the accused, emphasized “that only the 19-year-old main accused totally freaked out at the time. Only he used a weapon, i.e. a baseball bat.” The co-defendants only partially committed physical assaults. According to the indictment, the quartet followed the later victim through Straßwalchen and finally stopped them at an intersection.

The verdicts of the lay judges were then issued on Friday evening (chairman: Thomas Tovilo-Moik). The main defendant received three years partially conditional imprisonment (one year of which was unconditional) for intentionally causing serious bodily harm, among other things.

The three judgments against the accomplices: one year conditional plus 3420 euros unconditional fine, eight months partially conditional (one of them absolutely conditional), and twelve months fully conditional. The judgments are not yet final.
