The third person allegedly involved in the sexual assault that occurred next to a Petrer park is not prosecutable since he was less than 14 years old
Agents of the National Police have arrested two minors under the age of 16 in Elda accused of rape of the teenager of the same age in petrer. A third alleged implicated has less than 14 years. It is therefore unimputable for the purposes of the Minor Law, for which reason he has been left in the care of his parents, who will have to assume the compensation if so decreed by the Minors Prosecutor’s Office.
The arrests have taken place between the morning and the afternoon of this Thursday and in front of the Elda-Petrer National Police Station Dozens of relatives and friends have gathered, starting at six in the afternoon, which has made it necessary to reinforce security to avoid incidents.
The alleged perpetrators were identified one day after the sexual assault was committed, but as they were minors, the investigation was carried out with the utmost caution and discretion, while the evidence, medical reports and testimonies were collected and a reconstruction of the made in the same area with the victim.
As this newspaper announced last Monday, a under 16 years was allegedly raped by three minors in the vicinity of a park in Petrer. The teenager was finally able to escape and ask for help at an establishment in the commercial area of the Guirneywhere he arrived with a strong anxiety attack.
She was then transferred to Petrer II health center and from there to General University Hospital of Elda, where she was discharged after being hospitalized all night and being subjected to a meticulous forensic examinationin which they were evidenced injuries to forearms, legs and thorax.
The events occurred on the 9:30 p.m. last Friday in a small, well-lit urban garden located next to the Petanque Club Petrerin the green zone of the Pinada de Villaplana, next to the Rambla de Puça.
The victim was with a friend but she received a phone call and he left and, while she tried to contact through his mobile with the rest of the friends to go to meet him, he went assaulted from behind by three unknown young men who acted in the open.
They pounced on her without a word and they dragged her about fifteen meters until they descended to the nearby Rambla de Puça.
Everything seems to indicate that they wanted to take advantage of the lack of lighting and the lack of movement of people in the area. there it was raped by one of them while the other two held her violently. No one heard their screams, their pleas or their attempts to resist and escape had no effect.
Once the rape was consummated, she was able to leave the area and while she ran towards the establishment where her friends were, the attackers followed her down the street making jokes, humiliating comments, shouting and laughing.
The facts were denounced in the Police station of the Elda-Petrer National Police on Saturday, when the minor received the hospital discharge. She has been included in the care program for victims of sexual assault and has already started the tpsychological treatment to try to overcome trauma and emotional blockage.
The rape of the minor has generated a climate of social outrage and alarm in Elda and Petrer. Nearly 2,000 people gathered last Monday afternoon in the Campet de Petrer park to demand justice and show their absolute rejection of sexual assault. The participants, among whom was the entire local Corporation with Mayor Irene Navarro at the helm, held up banners and observed five minutes of tense silence that ended with a hearty applause of support and solidarity with the victim and her family.
Chargeable and unchargeable

In these cases, the perpetrators of any crime not only do not have criminal responsibility for their behavior, but also cannot be found guilty by the Justice. Inimputability can be decreed due to psychological disorders or lack of maturity. And this last assumption is the one that applies to crimes committed by under 14 years. Mental insanity, transitory mental disorder and alterations of perception are also causes for which inimputability can be declared.
