“Will you leave us the 3 points?”: Gianluca Gaetano disqualified for a message on WhatsApp

“Having regard to the communication from the Federal Prosecutor’s Office relating to the provision for the conclusion of the investigations referred to in proceeding no. 717 pf 21-22 adopted against Mr. Gianluca GAETANO and the company US CREMONESE spa, concerning the following conduct:

GIANLUCA GAETANO, at the time of the events registered footballer for US Cremonese Spa, in violation of art. 4, paragraph 1, of the CGS, for violation of the principles of fairness, correctness and sporting probity, to have, on 02 May 2022, before the Como – Cremonese match held on 6 May 2022, valid for the last day of the series championship B, sent to Mr. Vittorio Parigini, player of the opposing team, on 02.05.2022 through the WhatsApp messaging application the following message: “Will you leave us the 3 points on Friday?” with the addition of two emoticons representing a face in a moment of laughter; US CREMONESE spa, for strict liability pursuant to art. art. 6, paragraph 2, of the Sports Justice Code in force, for the acts and behaviors put in place by Mr. Gianluca Gaetano, as reported in the previous indictment;

– having regard to the request for the application of the sanction pursuant to art. 126 of the Sports Justice Code, formulated by Mr. Gianluca GAETANO and by Mr. Paolo Armenia, as legal representative, on behalf of US CREMONESE spa;

– having regard to the information sent to the Sports Attorney General;

– given the consent given by the Federal Prosecutor;

– noted that the Federal President has not formulated any observations regarding the agreement reached by the parties relating to the application of the penalty of 2 (two) days of disqualification in the Championship and a fine of € 4500.00 (four thousand five hundred) for Mr. Gianluca GAETANO and a fine of € 5000.00 (five thousand) for US CREMONESE spa;

– the agreement is disclosed as mentioned above “.
