A couple living near a country club in Massachusetts have received handsome compensation after living four years at the mercy of lost golf balls.

Athina and Eric Tenczar won their case after filing a complaint.

When Erik and Athina Tenczar bought a house in Kingston, Massachusetts four years ago, they forgot to factor in one unfortunate parameter. Their $750,000 property is indeed located near a country club. The couple did the count: in four years, nearly 700 golf balls have hit their home, denting the walls and breaking the windows. “At the moment of impact, it feels like a gunshot. It’s very scary,” Ahtina told NBC News.

Parents of three little girls, the two forties gave up repairing their windows a long time ago and opted for thick plastic panels to cover them. “We are always on the lookout. Emotionally, it’s trying,” says Erik. At the end of their tether, the couple decided to file a complaint against the company that built their house and against the golf club. After a deal was struck with Spectrum Building Inc., the Tenczars only took the country club to court.

In December, Plymouth County Superior Court ruled that the couple would receive $4.93 million in compensation. Jurors found the club at fault for failing to protect the house from stray golf balls. The Indian Pond country club appealed, saying the amount awarded to the Tenczars was excessive. The club’s lawyer also assures that Indian Pond has sought solutions for the family, in particular with the architect of the golf course.
