Court ruling – bankruptcy setback for Hertha investor Windhorst – Bundesliga

Difficult times for the former financial prodigy Lars Windhorst (44), who invested 375 million euros in Hertha BSC.

The Rechtbank Amsterdam, the finance court in the Dutch capital, has declared its Tennor Holding BV bankrupt (file number: 34355195).

A court spokeswoman confirmed: “Tennor Holding BV was declared bankrupt with a judgment on November 2, 2021.”

This means: The holding company cannot meet its current payment obligations in the opinion of the court. According to reports, it is about a claim by the Onassis organization, once founded by the Greek billionaire Aristotle Onassis (died 1975).

An insolvency administrator has already been entrusted with the procedure; he is now supposed to search for values in the business assets of Tennor Holding BV and, if necessary, sell them so that the creditor gets his money back.

How does the Windhorst side react?

Windhorst himself tweeted immediately after BILD had asked him for confirmation: “A decision by an Amsterdam court that declared a company belonging to my group, Tennor Holding BV, to be insolvent … we have appealed.”

Andreas Fritzenkötter, spokesman for the Tennor Group explains in detail: “There is a decision by an Amsterdam court that has declared a company in the group, Tennor Holding BV, to be insolvent. We immediately appealed against this decision and are sure that the decision will be reversed. We are not insolvent, do our business as normal, have a high cash flow. “

However, Fritzenkötter confirms: “From a purely legal point of view, this judgment will stand until our objection comes into force.”

Called: The insolvency of Tennor Holding BV was determined by a court. At the same time as the judgment, there should have been an agreement with the creditor.

Fritzenkötter continues: “The out-of-court settlement with the debtor ran in parallel. We reached an agreement on the same day. “

Does the bankruptcy have consequences for Hertha BSC? Windhorst owns 64.7 percent of Hertha BSC KGaA through another group of companies, Peil BV, and the purchase price of around 375 million has been paid in full to Hertha. Tennor spokesman Fritzenkötter assures: “The judgment does not affect the shares of Hertha BSC.”

However: The judicial determination that Tennor Holding BV is insolvent will worry Windhorst’s other financiers.
