The Council of State issued a ruling upholding the previous decision by the Regional Administrative Tribunal (TAR), which had earlier found in favor of the municipality. A.S.D. Rimini Baseball, administered by Ciro Esposito, had petitioned the high court to freeze the lower court’s decision and maintain temporary control of the venue. The administrative judges dismissed the request, determining that the association’s private interests are “recessive compared to the public interest” in returning the sports area to public administration.

Municipal officials at Palazzo Garampi are moving quickly to retake control of the stadium, but the legal and financial conflict is far from over. According to municipal calculations cited by Il Resto del Carlino, the association has accumulated nearly 400mila euros in unpaid debts during years of occupancy under an expired concession. The city claims approximately 185mila euros in unpaid utility bills—covering electricity, water, and gas services utilized between 2014 and 2025—alongside 81mila euros in waste management taxes and roughly 130mila euros in other municipal duties.
