Catalonia’s highest regional court has ordered expanded Spanish-language instruction for a specific student group in the Maresme region. It marks the first time the tribunal has explicitly anchored a local language-of-instruction ruling to a European human rights decision.
The decision focuses squarely on the Institut Escola El Pi Gros in Sant Cebrià de Vallalta. According to court documentation reviewed following recent legal proceedings, judges upheld a family’s petition for a higher percentage of Spanish-language teaching within a designated classroom group. In doing so, the bench anchored its legal reasoning in an overarching European Court of Human Rights (ECHR) ruling issued last June.
The Strasbourg Precedent and the Maresme Ruling
The legal shift stems directly from a European-level decision earlier this year. The Strasbourg-based court dismissed a challenge brought by families from the Turó del Drac school in Canet de Mar. Those families had contested the enforcement of a baseline 25% Spanish-language minimum in Catalan classrooms.
By dismissing that application, the European tribunal left individual national frameworks largely intact regarding regional language immersion policies. Seizing on that exact precedent, the TSJC integrated the ECHR’s findings into its legal rationale for the Sant Cebrià de Vallalta case.
