The argument

Expt. No. 28/24 Match:

LINIERS – STAR

Category: FIRST DIVISION

The report of judges Sánchez, Emanuel; Giannino, Sebastián and Enrique, Mariano from which it emerges first that during the course of the first half the referees gave notice to the leaders of the Liniers club since a part of the supporters of their institution exceeded the limits of the railings towards the field of game.

Subsequently and before the beginning of the last period, supporters of the Liniers club moved from their location to the stands where the supporters of the Estrella club were and physically attacked part of the visiting public with fist blows, generating a tumult between supporters of both institutions. As a result of the aforementioned attacks, players from both institutions approached the stands trying to separate the public given the existence of family members who were watching the match.

Once the incidents were quelled, the referees decided to suspend the match given that there were no guarantees for its continuity normally, having to wait about 30 minutes once the match was suspended to be able to leave the stadium, also informing that upon leaving and In the vicinity of the stadium, supporters of the Liniers club continue the riots.

That due to the seriousness of the reported events, the transfer was carried out for 72 hours. to both institutions in order to produce the corresponding discharge. That both institutions complied with the request by presenting a defense for the reported facts and providing elements of film evidence to the Estrella club, which will be credited by this Court at the time of issuing the resolution.

It should be added that some of the members of this Penalty Court were in the stadium at the time of the reported events and were eyewitnesses of them.

Considering the tenor of the facts reported by the judges, the defenses produced, the film evidence provided by the Estrella club and others that are public and well-known, in addition to the personal and direct vision by this court of the events that occurred, it is It appears that there is manifest, direct and absolute responsibility of the supporters of the Liniers club in the acts of aggression and violence that occurred, there being no type of justification or prior provocation on the part of the supporters of the Estrella club that would give rise to the commission of the crimes. acts of violence that are discussed here.

That the prevention and security measures adopted by the Liniers club were clearly insufficient, allowing violent supporters who are not part of the basketball family to enter its stadium, not using or exercising the right of admission, especially when there were recent antecedents. that occurred during the development of this play off series both inside the stadiums and outside them by the aforementioned supporters.

That for the purposes of preserving tranquility in the field of our basketball, and with the purpose of banishing these acts of violence that are unjustifiable in the field of sport, to which the family, which is an inalienable part and social engine of our clubs, permanently attends , which we must fully protect, so that they can attend peacefully and safely enjoying a show, measures must be taken to prevent the repetition of violent and shameful events that tarnish our rich basketball history.

Advance to semi-finals

At the time of the suspension of the match, Liniers led 52 to 42, after playing the first three quarters.

In addition, the albinegro had 10 consecutive victories and was 2-0 ahead in the series.

However, as a result of the TdP resolution, Estrella (5th) became the third semifinalist of the tournament, along with Bahiense del Norte (2nd) and Leandro N. Alem (3rd).

The remainder will emerge from the series being played by Villa Miter (1st) and 9 de Julio (8th).

Antecedent

On December 30, 2014, Liniers and Villa Miter played the fourth game of the final, at Casanova, which had a 2-1 lead over Chivo.

With 3m52 remaining and with the score 72-61 up, the albinegro, in the middle of a packed stadium, there was a chance clash between Mariano Pizzo (Liniers) and Juan Ignacio Gómez (Villa Mitre), which caused a
semi-deep cut on the latter’s head.

Juani was left lying on the parquet. The referees, rightly, stopped the match to attend to it. At that stop, while the players of both teams were chatting with each other, a Liniers supporter shouted from the local stand, at the same height where Gómez was being assisted: “Throw him some hamburgers”, in addition to other out of place outbursts.

That situation, and with the tension of a defining match, provoked the reaction, at first passive, of a tricolor fan. Of course, chaos already seemed to be unleashed.

Another plate player from Villamitrense turned around and shouted: “what the f…?”

At that moment, with astonishing calmness, a member of private security went to that area and tried to calm the waters, but was unsuccessful. Seconds later the beginning of the madness broke out.

A Villa Miter fan rushed into that area and threw a punch. At the same time, in another area of the Casanova, the bulk of the tricolor fans began to overcome the fences and headed towards the chiva stands.

Some albinegros sympathizers reacted, transforming that sector into a funnel.

Outside, too, there were fights and the police had to intervene.

Failure

The TdP of the ABB, in that situation resolved:

First: end the match, deciding to declare the Villa Miter club as lost and consequently the Liniers club as the winner in accordance with the provisions of art. 71 inc. “a” ap. 6 of the CP

Second: sanction the Villa Miter club with a fine of 12 AJC in accordance with the provisions of art. 60 inc. “chap. 2 of the CP

Third: sanction the Liniers club with a fine of 6 AJC in accordance with the provisions of art. 60 inc. “chap. 2 of the CP

The arguments were, verbatim: “Considering that the suspension of the match is fundamentally due to the active participation of the public of the Villa Miter club, who not only invaded the stand assigned to the Liniers club and neutrals, causing disorder and with a clear intention of physically attacking the spectators, but also the playing field, making the continuity of the match impossible and putting at serious risk both the physical integrity of the spectators as well as the players, referees and anyone who fulfilled any function assigned to the development of the game, and taking special consideration that this Court intends to protect, first of all, the physical integrity of all those people who are part of the show, as well as to try to eradicate violent people from the stadiums where this beautiful sport is practiced, allowing the basketball family to enjoy this game with complete peace of mind. type of spectacles and that events of such gravity as those that occurred never occur again.”
