The Falcons don’t have a way around Kirk Cousins’ Achilles injury, except for one situation.

The contract between Jimmy Garoppolo and the Raiders last year had a condition that allowed the team to back out if Garoppolo’s foot injury hindered his ability to pass a physical before the season began.

The Falcons do not have a way out unlike the Raiders in 2023, except for one very specific scenario.

It is not necessary for the Falcons and Cousins to stay united indefinitely. If both parties agree to part ways after one season, it would not be difficult to find another team for Cousins since he is only owed .5 million in salary in 2025. Despite Cousins having a no-trade clause, a pre-June 1 trade would result in a .5 million dead-money charge, but the Falcons would also avoid .5 million in additional guarantees to Cousins. As long as Cousins follows the instructions of the team’s doctor and head athletic trainer in regards to his Achilles injury, the Falcons are responsible for the entire million amount.

Having said that, they would still have given him a payment of .5 million for just one season, in the event that he is traded in 2025.

My confused state prompts a question: Can the Falcons escape the Cousins contract by having quarterback Michael Penix Jr. be their eighth overall pick and not allowing him to pass a physical before a certain deadline?

Penix is undoubtedly the way forward. The sooner the Falcons can appoint Penix as their current leader, the more beneficial it will be for them in the long run.

According to an individual familiar with the agreement, in order for Cousins to receive his million signing bonus, he must pass a physical exam. However, his pre-existing Achilles injury is not covered by this bonus, as long as he continues to follow the rehabilitation plan set by the Head Team Physician and Head Athletic Trainer of the team.

The ultimate factor is when the Falcons choose to transition to Penix. They have attempted to ease tensions by proposing that Penix may potentially wait for four to five years, but this is illogical. In reality, switching to Penix could occur in the next one to two years without significant contractual challenges for the team.

A transaction conducted between 2025 and June 1, 2026 would lead to a reduced cap fee of million. In this situation, the Falcons will have given Cousins a total of million for a two-year period.

At the start of the year, Kirk Cousins stated at his first media appearance in Atlanta that he had cleared a physical for all areas except his Achilles tendon injury. He mentioned that he would need to pass a separate physical specifically for his Achilles at a later time.
