Oral trial opens against Luis Rubiales for his kiss with Jenni Hermoso

The judge of the National Court Francisco de Jorge agreed this Wednesday to open an oral trial against the former president of the Spanish Football Federation (FEF) Luis Rubiales for his non-consensual kiss to Jenni Hermoso after the final of the Women’s World Cup held in Sydney (Australia) last August 20. Rubiales is accused of an alleged crime of sexual assault and another of coercion of the national team player, for which the former coach Jorge Vilda, the former sports director of the men’s team Albert Luque and who was responsible for marketing of the team are also accused. The magistrate of the ‘Rubiales case’ has given Rubiales a period of 24 hours to post a bail of 65,000 euros to face any possible civil liabilities to which he could be sentenced for sexual assault. The same amount must be recorded for a crime of coercion, jointly and severally, with Vilda, Luque and Rivera. There is no appeal against this resolution made public this Wednesday. The Prosecutor’s Office requests two and a half years in prison for Rubiales, one year more than for the rest of the defendants, for a scandal that went around the world and that, in the face of social, political and sporting pressure, forced the then Granada leader to abandon his position at the head of the FEF.

Judge De Jorge warns Rubiales and the other three defendants that if they do not provide the required bonds, “properties will be seized in sufficient quantities to secure the indicated sum.” “The accused are granted the common period of 10 days to present a defense brief against the accusations made,” adds the head of the Court of Instruction number 1 of the National Court.

The Criminal Chamber of the National Court already confirmed two weeks ago that Rubiales, like Vilda, Luque and Rivera, must sit on the bench for the famous kiss to Jenni Hermoso and the subsequent pressure on the soccer player and her entourage to The Madrid player assured that it had been consented. On April 22, the National Court rejected the appeals filed by the four defendants against the order of the magistrate who proposed trying them.

Already in the month of January, Judge De Jorge proposed judging Rubiales, considering that the kiss he gave to Jenni Hermoso “was not consensual” and that the then president of the FEF acted “unilaterally and surprisingly,” in addition to highlighting in its resolution that “the pressures to which the player was subjected” caused in the soccer player “a situation of anxiety and intense stress.” Vilda, Luque and Rivera will also go to trial after the magistrate has estimated that “there was a concerted action by the three accused”, concerted with Rubiales, to intimidate Jenni Hermoso and try to get the player to record a video in which she expressed that the kiss was not forced, but had the consent of the world champion.
