The US requests a second labor panel with Mexico due to complaints from telephone operators – El Sol de México

The United States requested for the second time a panel of the Rapid Response Labor Mechanism (RRM), within the framework of the Free Trade Agreement between Mexico, the United States and Canada (T-MEC), due to the complaint of a union of telephone operators who denounced that the company Atento Servicios, based in Pachuca, Hidalgo, interfered in their union activity.

The United States trade representative, Katherine Tai, reported that the request of this panel is to follow up on a request that the United States sent to Mexico on January 18, 2024 to review whether Atento Servicios workers were being denied their rights to freedom of association and collective bargaining.

“Our panel request reflects our relentless commitment to using the MRR to protect workers’ rights and ensure equity for workers,” said Ambassador Tai.

A month earlier, on December 18, 2023, the Interinstitutional Labor Committee for Monitoring and Enforcement (ILC) received a request from the Telephone Operators Union of the Mexican Republic for a Rapid Response Labor Mechanism.

The request alleged that Atento Servicios interfered in union activity, to the extent of threatening and dismissing workers as retaliation for carrying out union organizing activities.

After reviewing the petition, it was determined that there was sufficient evidence of violation of union rights. For this reason, the United States trade representative, Katherine Tai, asked Mexico to review these labor violations.

In a period of 45 days, Mexico examined the case and found that there was a violation of rights. However, it was specified that Atento Servicios took the necessary actions to remedy the violation of rights during the review period.

Despite this, the United States Trade Representative disagreed, which is why it will advance the Rapid Response Labor Mechanism.

“The MRR is a proven and critical instrument to defend the free exercise of freedom of association and collective bargaining rights. We remain open to collaborating with the Government of Mexico to find a solution to this matter and achieve a fair result for all workers involved,” Tai explained.

According to the United States Trade Representative, both countries have already cooperated on 17 Rapid Response Labor Mechanisms to successfully resolve labor rights violations.
