Court Grants Generic Mitigating Circumstances in Sentencing of Alessio De Falco for Murder of Tunisian Bartender

Twenty-two years of imprisonment, against a request for a life sentence. The second section of the Court of Assizes of Naples does not accept the sentence quantified by the Prosecutor’s Office of Naples North and thus, excluding the aggravating circumstance that had contested the accusation, grants generic mitigating circumstances to Alessio De Falco, 23 years old, nephew of the boss Nunzio known as “o’ Lupo”. The defendant was accused of the murder of a Tunisian bartender, Imhed Zilmed53 years old, after an argument that occurred on November 12, 2022, at three in the morning, in a bar in Casal di Principe. The trial, although instructed by the Prosecutor’s Office based in the Palace of Justice located in the Aragonese Castle of Aversa, was celebrated in the courtroom of the Court of Assizes of Naples as an Assizes section has not yet been established in North Naples.

INSIGHTS

To defend The Falcon, the lawyers Mirella Baldascino and Pasquale Diana, who insisted above all on the medical aspect. The victim entered the hospital with a head injury, going to the hospital himself Giugliano in Campania. Once discharged, after twelve days, he returns to hospital with problems relating to the respiratory tract, relating to damaged capillaries.

The expert report speaks of a lung infection without excluding responsibility for the trauma received, a detail that did not convince the defense very much: the victim was discharged from hospital without ever being intubated or placed in intensive care. The bartender was bashed in the head with a baseball bat after an altercation that arose over trivial reasons, apparently over a beer that the defendant didn’t want to pay for. At this point the baseball bat would appear, taken out by the bartender and hidden under the counter and used to defend himself, which was taken out of his hand by De Falco: at this point the 23-year-old would not have hesitated to massacre the Tunisian.

From the autopsy it emerged that the victim – who personally went to Giugliano hospital to be treated – also suffered from a bronchial pathology but, in the end, as mentioned, it was ascertained that the blows inflicted and the very serious injuries were the cause of death. From Giugliano in Campania the Tunisian was transferred due to the seriousness of his conditions to the hospital in Pozzuoli, and then passed away in an Rsa facility in the upper Caserta area where he was then placed. The military personnel who carried out the arrest ascertained through the images of the cameras and some testimonies that the Tunisian was hit several times for trivial reasons by the young man. De Falco did not hesitate to violently strike the victim’s head with the heavy baseball bat. The young man had just been released from house arrest after an arrest for resisting a public official in Formia but he is no stranger to attacks of this kind, apparently he was a regular at fights in bars.

In 2021 he violently attacked a Romanian barmaid. The Falcon, who was with his twin brother, hit the girl for a denied beer that he had asked to consume in a club in San Cipriano d’Aversa. Grabbed by her hair, the woman was slammed with her head against the bar counter and heavily threatened with phrases such as “I’ll shoot you, I’ll kill you”. In this case, ironically, it was a Tunisian who paid the bill for the two young people to avoid arguments. After the conviction, De Falco benefited from the suspended sentence and then became the protagonist of yet another argument, this time which ended tragically with the death of the bartender of Tunisian origin. The reasons for the verdict will be filed after the summer.
