The Supreme Court of Brazil rejects Robinho’s appeal and confirms his prison sentence

The Federal Justice of Brazil issued this Thursday an order of prison against the ex-footballer Robson de Souza ‘Robinho’ to begin serving the nine-year prison sentence imposed on him for a rapeaccording to official sources.

The prison order was issued by the Federal Justice in the state of São Paulo, immediately, upon learning that Judge Luis Fux, of the Supreme Court, rejected a habeas corpus appeal presented by the former Real Madrid, Milan and Manchester City player.

The moment of arrest of the 40-year-old former soccer player could occur at any time and the execution of the order depends on the Federal Police, according to Federal Justice sources told EFE.

Robinho resides in a luxury development in Guarujá, a city on the coast of São Paulo, although he owns several residences in this region, including several apartments in the neighboring city of Santos, where he began his professional career.

This Wednesday The Superior Court of Justice of Brazil decided that Robinho will have to serve in Brazil the sentence imposed on him in 2017 by an Italian court for a gang rape committed in Milan in 2013.

Robinho was tried in absentia and cannot be extradited to Italybecause the Brazilian Constitution prohibits it.

During Wednesday’s session, the former Real Madrid soccer player’s lawyer pointed to alleged violations of due process in Italy and stated that the Brazilian law that allows the homologation of foreign sentences comes after the crime committed, arguments that were rejected by the investigating judge. The magistrate explained in his vote that it is not up to the Brazilian Justice to review the sentence already firmly issued by an Italian court or open a new trial, but only to review whether all the requirements are met to accept Italy’s request for the athlete to serve his sentence in Brazil.

Robinho, 40, was convicted for his participation in a gang rape of a young Albanian woman in a nightclub in Milán in 2013, but he never served his sentence because he returned to Brazil.
