The prosecution demanded this Wednesday, March 27, two and a half years in prison against Luis Rubiales in the case of the forced kiss of the player Jenni Hermoso, according to the requisitions, published before the trial of the former president of the Federation Spanish Football Association (RFEF). The latter is being prosecuted for “sexual assault” and the offense of “coercion” after having surprisedly kissed the number 10 of the Spanish team on the mouth in August 2023, a few minutes after the coronation of “Roja” in the Copa do world, a gesture that provoked indignation in Spain and abroad.

Luis Rubiales, who has denied since the beginning of the affair any “sexual connotation” to his gesture, claiming to have acted under the influence of “emotion” and in “a moment of happiness”, ended up resigning, saying he was a victim of a “disproportionate campaign”. The former strongman of Spanish football was also suspended for three years by Fifa with a ban on approaching the player.

Since a recent reform of the Spanish Penal Code, a non-consensual kiss can be considered sexual assault, a criminal category bringing together all types of sexual violence.
