Robinho in prison in Brazil after conviction for rape

Robinho was arrested. The former AC Milan striker begins serving a 9-year prison sentence after being convicted of the rape of an Albanian woman, an episode that occurred in Italy in 2013. The Brazilian had already been convicted in all instances of Italian justice up to the Court of Cassation. Last Wednesday the Brazilian Supreme Court of Justice decided – with 9 votes to 2 – that the former footballer would have to serve his sentence in his country. The Brazilian constitution in fact prohibits the extradition of its citizens abroad: if convicted, they must be arrested in Brazil for crimes committed outside its borders.

The Federal Justice of Santos received the letter from the Supreme Court in the afternoon and issued the arrest warrant in the early evening. The former player was taken to the city’s Federal Police headquarters a few hours later. Robinho lives in a luxury condominium in Guarujá, a municipality located on an island near Santos, in the state of Sao Paulo: Brazilian police officers picked him up there. The former player will undergo a custody hearing, a forensic examination and then be sent to prison.

The former footballer’s lawyers tried to overturn the decision with a writ of habeas corpus at the Supreme Federal Tribunal (STF), Brazil’s highest legal body, equivalent to the Court of Cassation in Italy, so that Robinho could await trial appeal in freedom. Minister Luiz Fux, responsible for analyzing the injunction, denied it. Robinho’s defense will now try to present appeals, contesting the points of the sentence. But this process will take much longer. Barring any surprises, Robinho will be in prison in the meantime.
