In 2008, the CAS ruled in favor of the reluctant clubs

In 2008, the Court of Arbitration for Sport was asked to rule on the obligation of clubs to release their players under the age of 23 retained by their selections for the Olympic Games. Seized by Barça, Schalke 04 and Werder Bremen at the time – for Lionel Messi, Rafinha and Diego – the CAS ruled in favor of the clubs wishing to keep their players, explaining that “the Olympic tournament does not appear in the calendar official FIFA and there is no decision from the FIFA executive committee which establishes an obligation to make players under the age of 23 available for this tournament.
