The office insists that the man must remove his headgear in the school premises.
Previously, there were initially only internal discussions between the teacher Marcus Burkert and the school management, but then a delegation from the school authority visited the Josef Dosch primary school in Gauting and then wrote to the teacher.
School authorities want to ban teachers from wearing baseball caps at school
The office is demanding that primary school teachers take off their caps at school in the future. The authority claims that this also applies to the students. “According to the school rules, students are required to remove their head coverings in the school building. Since teachers have a role model effect, this regulation naturally also (indirectly) applies to them,” explained school district director Manuela Hollweg in a statement to Merkur.
As a civil servant, according to Article 75 of the Bavarian Civil Service Act, the teacher must maintain a certain appearance. There is no specific rule, but the elementary school in Gauting has the right to set the rule that way, the office argues.
Teacher finds the rule out of date
In any case, the teacher finds the debate completely alien. “This is a view that is completely out of time,” Burkert told Merkur. “Who am I to tell children what they have to wear?” In view of the blatant shortage of teachers, he finds the regulation particularly nonsensical. When it comes to the children, he also thinks it is important to convey the subject matter to them rather than telling them a dress code.
But the school authority insists on adhering to the rules: “If a teacher persistently refuses to comply with such orders, she must ultimately – like any civil servant – expect supervisory or even disciplinary measures,” says the head of the school authority. The teacher, however, does not want to give in and points out that the rules are not applied uniformly. “The law doesn’t allow me to be obliged to do this,” he says. ■
