The 2010 capital increase, another ruckus at Málaga CF

Málaga CF is the club in trouble. It seems that in the offices of the Martiricos entity absolutely nothing has been done well for many years, even when the team was experiencing the best years in its history on the pitch. In addition to the current legal troubles between BlueBay and the Al-Thani and the Small Shareholders association of the Qatari club and family, there is another issue that has still been ongoing since 2010: a capital increase in which many fans feel cheated.

Back in 2010, Fernando Sanzpresident of Málaga CF at the time, proposed a capital increase to which many blue and white fans attended in search of helping the club financially. In total, there are more than 700 affected people, who bought a total of 1,300 shares, and more than 13 years later they do not have them recognized. Each of the shares had a value of 50 eurosbut the majority of these fans do not demand the money, but rather that they be recognized for their participation.

One of these victims is Francisco Verdún, who has sued Málaga CF for recognition of the share he purchased in the 2010 capital increase. The letter, revealed by Radio Marca Malaga and to which this newspaper has had access, requests the following:

I PLEASE TO THE COURT: That considering this document has been presented with the documents attached to it, you deign to admit it and in its virtue, have this plaintiff appear, by filing a DEMAND FOR VERBAL TRIAL against the entity MALAGA CLUB DE FÚTBOL, SOCIEDAD ANÓNIMA DEPORTIVA , summoning it to appear, if it is appropriate to its right, and prior to the appropriate procedures, GIVEN A JUDGMENT UNDER WHICH THE ENTITY MALAGA CLUB DE FÚTBOL, SOCIEDAD ANÓNIMA SPORTIVA, IS CONDEMNED to undergo the pronouncements determined below .

1.- Recognize Mr. Francisco Verdún Pérez as owner and legitimate owner of ONE SHARE dand the entity Malaga Football Club SAD, and as a consequence of this, in its capacity as shareholder of said company.

2.- Register in the Registry Book registered shares of the entity Málaga Club de Soccer SAD as the owner of a share to Don Francisco Verdún Pérez, with all the procedures that legally correspond according to the applicable legislation, among them, that the ownership of said share be communicated to the Higher Sports Council.”

In the Verdún complaint, Joaquín Jofre, one of the former club leaders identified by the Prosecutor’s report in the Al-Thani Case, comes to the fore again, and also shoots against José María Muñoz, current judicial administrator of the club:

“The actions of the company in 2022 through its judicial administrator We find it extremely regrettable and contrary to law.. In the words of the judicial administrator himself, the order of February 19, 2020 that appointed him as judicial administrator of Málaga CF and Nas Football “expressly declared that the purpose of the Judicial Administration was to protect the assets of Málaga CF, as well as the rights of its minority shareholders and workers. However, The criterion adopted by the judicial administrator in relation to that third point does not respond to that purpose, in our opinionbut rather unfairly harms minority shareholders, violating their rights.

This is so because “the solutions” he preaches are clearly contrary to the law.”
