BarcelonaThe far-right party La Llibertat Avança, of Argentine President Javier Milei, presented this morning a project to repeal the abortion law and make it a crime punishable by prison terms for both women and health professionals. Abortion was legalized in Argentina in January 2021, after a large wave of protests by the Green Tide movement.

The new bill does not provide for exceptions in cases of rape, although it leaves it to the discretion of the judge to provide an exception to the penalty for the woman “in consideration of the reasons that prompted her to commit the crime, her later attitude, and the nature of the act”. The penalty for the woman would be one to three years and in the case of health professionals one to four years. The penalties are higher if the abortion is not consented to or if the woman dies

The text presented to the Chamber of Deputies is headed by the slogan that the Milei executive recently published in Official Bulletin: the declaration of 2024 as the ‘Year of the Defense of Life, Liberty and Property’. In January, in his speech at the World Economic Forum in Davos, the president attacked the agendas of feminism and the environment, which he said “socialism” has managed to sneak into international bodies.
Approved on December 30, 2020 and promulgated on January 14, 2021, Law 27,610 on voluntary termination of pregnancy (IVE) allows abortion up to the 14th week of pregnancy safely, legally and free of charge, always in a maximum of ten days from the request. Beyond these 14 weeks, abortion is only permitted if the woman’s life is in danger or if the pregnancy was the result of rape.
At the last demonstration held in Argentina for the Day of Action for the Decriminalization of Abortion in Latin America, last September, in the middle of the electoral campaign, feminist groups had expressed the fear that an eventual government of the ultra-right meant a setback in the successes of the Green Wave. The first protests have already been called in response to the new bill.
