BlueBay, co-owner of Málaga CF: What now?

Málaga CF’s short-term outlook may have taken a new turn with the Supreme Court’s decision to dismiss Al-Thani’s latest appeals. The Qatari has definitively lost, without the possibility of prolonging it further, his litigation against BlueBay, which now owns 49% of Nas Spain 2000, a company that controls almost 97% of the total shares of the blue and white club.

With this new decision from the Supreme Court, new short-term scenarios open up in the Martiricos entity. One thing should be clear, for now the sheikh continues to maintain the majority of the club, but that could also change in the coming months, once the other lawsuit that concerns the ownership of Málaga CF is resolved. With that 51% of Nas Spain 2000, plus another package of shares that he bought at the time with money from the club itself – this purchase is also contested -, The Qatari would continue to control more than 50% of the club’s shareholders, but new decisions could come from the courts that give a radical turn to the situation.

Firstly, the trial between the club’s Small Shareholders Association and the Al-Thani continues. It has already been agreed to end the investigation phase, and then the case will change courts. Justice has its deadlines and we will have to be attentive in the coming months to the new steps taken from the courts. The trial, if there is one, could continue for more than a year.

However, in that same process there is another cause that could be decisive for Málaga CF. Al-Thani made a purchase of seized shares from Fernando Puche with money, supposedly, from the club itself, and not from his pocket, and that package that does not reach 1% of the total would be the one that the majority of the club would continue to give him. If this acquisition is invalidated, Al-Thani could see how he loses all of his power in the club, even if he is acquitted of the rest of the crimes he is accused of.

Judicial administrator status

After this, there is a question that remains in the air: What position is the judicial administrator José María Muñoz in now? Well, for now there would be no change. The decision to end the judicial administration and propose another type of governance at the club would have to be made by the courts. So, in the short term, and as long as his honorable Members do not say otherwise, José María Muñoz will continue to command the ship, when he is about to celebrate his fourth anniversary at the head of the entity. Another thing is what Jamal Satli Iglesias’ hotel company may claim in the near future, as the legitimate owner of almost half of the club.

Plus 8 years of trial

Satli Iglesias was in full litigation with Sheikh Al-Thani since 2015 for all the shares of the joint company NAS Spain 2000 that the Qatari claims as its own and which owns 97% of the club’s shares. 51% of the shares belong to the sheikh and 49% to the hotel company, a ruling that has been ratified by the Supreme Court, according to Sur, after the last appeal presented by Al-Thani’s defense.

The Provincial Court of Málaga had already rejected the appeal presented by the former president and majority shareholder of Málaga, the Qatari sheikh Abdullah Al Thani, against the sruling of June 5, 2019 that granted the company BlueBay 49 percent of the capital of the club held by the company Nas Spain 2000.
