2. Eligibility to participate in quotation submission

○ The company must be registered as a business with a license for “building construction business” or “civil engineering construction business” among the general construction businesses under the Framework Act on the Construction Industry.

This is a construction project that requires management and coordination, and is a mutual market between general and specialized construction industries following the abolition of regulations in the construction industry (effective on January 1, 2011).

5. How to determine the contract partner

○ The expected price is determined by each bidding company based on 15 different multiple reserve prices created within the range of ± 3% of the basic price using the “multiple reserve price creation program” of the 『National Electronic Procurement System (g2b)』 Of the two numbers selected, the four most selected are automatically drawn, and the arithmetic average price is automatically determined as the expected price.

○ The estimated price is calculated by reducing the sum of national pension insurance premiums, national health insurance premiums, retirement savings contributions, long-term care insurance premiums for the elderly, occupational safety and health management expenses, safety management, and quality control expenses (hereinafter “national pension insurance premiums, etc.”) from the estimated price. Among those who submitted the reduced amount of national pension insurance premiums, etc. by 87.745% or more, those who submitted the lowest price are in order of disqualification according to Chapter 5 Guidelines for Negotiated Contract Management of the Local Government Bidding and Contract Execution Standards. After screening, those who do not fit any of the criteria will be selected as contract partners.

○ If the first-priority person is disqualified for a small private contract and it is difficult to conclude a contract (including those who submitted a waiver), the contract partner will be determined by additional screening for each second-priority person to determine whether they are disqualified from the private contract without re-announcement. However, if the next-highest-ranking person gives up on concluding a contract based on the wishes, it will be considered a waiver of the contract for justifiable reasons and no separate sanctions will be imposed (however, a waiver form must be submitted).

6. How to submit a quote and submit a quote

○ This bid will be conducted only through electronic bidding, and fingerprint recognition will be applied to the bid. However, those who have difficulty in bidding through fingerprint recognition identification may exceptionally submit an electronic bid using a business certificate and personal certificate in accordance with the procedures in Article 7, Paragraph 1, Item 7 of the National Comprehensive Electronic Procurement System Electronic Bidding Special Note.

7. Restrictions on participation in quotation submission

○Companies that fall under the provisions of Article 33 of the Act on Contracts to which Local Governments Are Parties are restricted from participating in quotation submission.

8. Invalidity of bid

○Article 39, Paragraph 4 of the Enforcement Decree of the Act on Contracts to which Local Governments Are Parties, Article 42 of the Enforcement Rules of the same Act, Chapter 11 Bidding Instructions of the「Local Government Bidding and Contract Execution Standards」and「National Integrated Electronics」 Pursuant to the Procurement System Electronic Bidding Special Instructions.

9. Matters related to subcontracting

○ The possibility of subcontracting for this construction, subcontracting approval procedures, etc. are subject to individual laws such as the Basic Construction Business Act.

○ When subcontracting, the subcontracting regulations of individual laws such as the Basic Construction Industry Act must be observed.

○ Violation of the restrictions on subcontracting under the Framework Act on the Construction Industry, the Electrical Construction Business Act, the Information and Communications Construction Business Act, the Software Promotion Act, and other laws in accordance with Article 31 (1) 3 of the Act on Contracts to which Local Governments Are Parties. Those who subcontract, those who subcontract without approval from the ordering office, and those who change the terms of subcontract approved by the ordering office may be restricted from participating in the bidding process as illegal business operators.

○ In accordance with Article 31 (1) 5 of the Act on Contracts to which Local Governments Are Parties, the Fair Trade Commission has restricted bid participation qualifications for violating the Monopoly Regulation and Fair Trade Act or the Fair Subcontracting Transaction Act. Anyone who makes a request may be restricted from participating in the bidding process as an illegal contractor.

10. Submission of integrity contract implementation pledge

○ All companies participating in the bidding are considered to have submitted the Miryang City Integrity Agreement Pledge.

○ The company selected as a contract partner must submit a pledge to fulfill the integrity contract of Miryang City at the time of signing the contract, signed by its representative.

11. Labor cost classification management and payment confirmation system

○ This construction confirms payment of subcontracting fees, etc. and “classifies management and payment of labor costs” in accordance with the provisions of the “Local Government Bidding and Contract Execution Standards” and “Chapter 13 General Conditions of Construction Contracts, Section 9 Inspection and Payment and Section 11 Subcontracting.” This is a construction project to which the “confirmation system” is applied, and an agreement on the labor cost classification management and payment confirmation system must be submitted at the time of construction commencement.

12. Settlement of national health insurance premiums, national pension insurance premiums, long-term care insurance premiums for the elderly, etc.

○ Health insurance premiums, pension insurance premiums, long-term care insurance premiums for the elderly, etc. are settled after the fact (establishment and payment) in accordance with Article 89 of the Enforcement Decree of the Act on Contracts to which Local Governments Are Parties and the Standards for Local Government Bidding and Contract Execution. 13. Matters regarding the use of “Subcontract Keeper” (government contract subcontract management system)

15. Other matters

○ Contractors must submit a wage payment pledge and a consent form for direct payment of unpaid wages when concluding a contract in accordance with the provisions of the “Milyang City Ordinance for the Operation of Government Construction without Unpaid Wages.”

○ The contractor or subcontractor must submit the construction equipment rental payment guarantee (or direct payment agreement) to the orderer before the construction start date.

○ When concluding a contract, stamp duty must be paid in accordance with the Stamp Duty Act, and when payment is requested after completion of the contract,

Gyeongsangnam-do regional development bonds equivalent to 1.25% of the claimed amount must be paid.
