Man convicted of manslaughter in car accident turned murder

An argument in a car accident 4 years ago led to a murder. A Chinese man was convicted of manslaughter and sentenced to 16 years in prison.

The Shah Alam High Court today sentenced former information technology employee Yao Weiliang (transliteration) to 16 years in prison for manslaughter in a car accident four years ago.

Judge Julia Ibrahim made the above sentence after hearing arguments from both the prosecution and the defense regarding the penalty before sentencing today.

“The defendant was found guilty of manslaughter under Section 304(a) of the Penal Code (manslaughter), but it did not amount to murder.”

Julia ordered that the prison sentence of 45-year-old Yao Weiliang be calculated from the date of his arrest, that is, August 10, 2019.

On August 10, 2019, the defendant was driving along the Long Phu Expressway and heading south from the Bangi Toll Station when his car was hit from behind by the deceased Syed Mohd Daniel. As a result, the two chased and provoked each other on the road.

In the end, the two stopped in the express lane to argue, and then started fighting. After passers-by stopped the fight, the two went back to their cars.

But the deceased could not hold himself back, so he took out a baseball bat from the car and hit the hood of the defendant’s car. The defendant in the car panicked and stepped on the accelerator, knocking the deceased into the crash barrier. The latter died after being sent to the hospital.

Later, the defendant was charged with murder on August 22, violating Article 302 of the Penal Code, which provides that the only penalty upon conviction is death. The High Court ruled in July this year that the defendant was found guilty and needed to appear in court to defend himself.

When Julia sentenced the case on the 5th, she found Yao Weiliang guilty of manslaughter on the basis that the prosecution’s evidence successfully proved that the defendant had committed a crime that violated Article 304 of the Penal Code (manslaughter).

She said at the time that the prosecution had succeeded in proving the case beyond reasonable doubt under Section 304 of the Penal Code.
