Transfer market, new rules for agents: the European Commission has given its approval

The European Commission promotes the Farthe new agent regulations launched by FIFA and entered into force last October 1, deeming it compliant with European Union law. At this point the ball goes to Court of Justice of the European Unionwhose verdict is expected in 2025 (first there will be the preliminary opinion of a general advocate, as already happened with the Superlega case).

FIFA’s objectives with the Ffar

The new agent regulation is valid for both international transfers and those within national borders. After its entry into force, several associations of attorneys filed lawsuits to cancel the legislation. But after the favorable opinion of the Court of Arbitration for Sport (TAS) of Lausanne, here comes the green light from the European Commission. Brussels recognizes this legitimizes FIFA’s request for agents to undergo a licensing regime capable of guaranteeing uniform standards at an international level. Not only that, in the 48 pages sent to the EU Court of Justice, the Commission underlines how any restriction of competition is justified by FIFA’s objectives: the world’s highest football body aims in this way tocontractual stability it’s at limit conflicts of interest.

The cap on commissions

The Commission also gave the OK to maximum commission cap, opposed by prosecutors. A ceiling which, according to the EC opinion, protects the financial interests of the players and guarantees that national leagues do not compete unfairly with each other to secure top players with higher agent fees.

Furthermore, the Ffar prevents attorneys from representing all three parties in a transfer and also on this point the European Commission expressed itself favorably: even for the EC, in fact, an agent cannot represent the interests of the player involved in the sale and, at the same time, look after the interests of both clubs. While waiting for the Court of Justice to rule, FIFA obtains another victory. This time on the table of the European Commission.
