The Court of Accounts refuses to suspend the accounting trial against Puigdemont due to the ‘procés’

The lawyer of the former Catalan president had claimed it when considering that the jurisprudence of the Supreme Court prevents the accounting liability from being resolved without a final criminal sentence.

The Court of Auditors has refused to suspend the hearing scheduled for next day the 17th due to the accounting responsibility of the former Catalan president Carles Puigdemont and the independence leaders Toni Comín, Clara Ponsatí and Lluis Puig for his performance in the ‘procés’, as specified in two orders issued by the counselor of the Second Department of the Prosecution Section of this supervisory body.

The lawyer Gonzalo Boye, representing Puigdemont, had demanded the suspension of the process because, as I understood, the jurisprudence of the Supreme Court prevents the accounting liability from being resolved without a final criminal sentence.

However, the counselor considers that this is not a new issue, given that said request was already raised by the lawyers of the four co-defendants at the prior hearing held on December 16, 2022, and was dismissed. The Court of Auditors considered that “The suspension requested due to application of the principle of compatibility between the criminal and accounting jurisdictions is not appropriate.“, specifies the first provision.
