European justice refuses to recognize ownership of brand rights

The latter refused this Tuesday to recognize ownership of the rights to the “Maradona” brand by the Sattvica company.

European justice refused on Tuesday to recognize the ownership of the rights to the brand “Maradona» to the Sattvica company, controlled by the former lawyer of the Argentine football star who died in 2020.

Sattvica is a company which was created in particular by this lawyer, Matias Morla, after receiving a power of attorney from Diego Maradona for the commercial use of his name, with the aim of providing financial support to his sisters. “The court of the Court of Justice of the European Union rejects Sattvica’s appeal“, announced the court in a press release.

«The documents provided in support of the transfer request do not justify a transfer of the brand for the benefit of this company“, he clarified. The tribunal “confirmed” Thus “the assessment of the EUIPO», the European Union Intellectual Property Office, he adds. The EUIPO thus rejected in March 2021, for the same reasons, the request for recognition of its rights to the brand that Sattvica and the player had sent to it before his death.

This decision of the CJEU court may be appealed to the Court of Justice. The CJEU in fact comprises a tribunal and a Court. In 2021, the Argentine courts rejected an appeal brought by the footballer’s two eldest daughters, Dalma and Gianinna, in a legal battle against Matias Morla. This allowed the lawyer to continue using the brand “Maradona».
