Boca Juniors Elections Postponed to Sunday, December 3

The Court of First Instance for Criminal, Misdemeanors and Misdemeanors No. 22 had granted on Thursday a request from the DAIA to postpone the elections from Saturday the 2nd to Sunday the 3rd due to Shabbat. “The Boca Juniors Athletic Club informs that the Criminal Contravention and Misdemeanor Court No. 22, whose subrogation is exercised by Dr. Ricardo Feliz Baldomar, and at the request of the Prosecutor Dr. Diego Espada, ordered to annul the designation of Saturday, the 2nd of December 2023 as the date chosen for the renewal of authorities and set, in its replacement, Sunday, December 3, 2023, with the prosecution being in charge of the obligation to arrange everything necessary to comply with the court order. This decision was made on 11/23/23 at 7:48 p.m.

By virtue of this court order and considering that any procedural remedy attempted would only bring greater uncertainty to the members of the institution given the limited time before the elections, it is reported that the Club will abide by such decision. despite the serious irregularities committed in the case.

This decision of the Club, however, requires that all members and fans be made aware of the serious background surrounding the case:

A) On 11/06/23 the DAIA presented the Club with a note requesting the possibility of changing the date of the elections on the occasion of Shabbat.

B) Given the importance of the request and in order not to violate the general rules or regulations of the Club, authorization was requested from the competent authority, which is the General Inspection of Justice.

C) The General Inspection of Justice responded that any change that was made without the due notice provided for in the entity’s statute would constitute a serious violation thereof. This meant that there was no time necessary to make the aforementioned change without violating Boca’s statute.

D) For this reason, the DAIA was responded to on 11/14/23 regarding the impossibility of accessing the change request, due to the opinion received from the control authority.

E) On November 17, the Prosecutor’s Office No. 30 in charge of Dr. Diego Espada received a telephone complaint from five apparent members of the club who denounced discriminatory acts against them given the establishment of the election act set for the Saturday, December 2, 2023.

F) With that single call, the intervening prosecutor, without verifying the identity of the complainants and without requiring them to ratify the complaint, proceeded to process it.

G) The CABJ lawyers were summoned by the prosecution to a hearing to be held on November 23, 2023 at 2:00 p.m., where Boca Juniors was present as appropriate but strangely, none of the complainants showed up.

H) On the day of the hearing, 11/23, at 11:46 a.m., before the hearing, the prosecutor asked the court to modify the date of the election, which made it difficult to understand the reason why it was decided. He summoned Boca to the hearing that was later.

I) On the same day, 11/23, the representative of the CABJ presented two briefs, one before the prosecutor’s office and another before the intervening court, through which it was requested that the complainants be summoned beforehand to ratify the complaint since it was known that three of They denied having participated in the complaint, and also that they had not authorized anyone to use their names for any purpose, which appeared to be a fraudulent and malicious use of them (a statement ratified by a testimonial record submitted before a notary of those three partners. where they express that their names and data had been used without their consent).

J) That is, the CABJ informed both the prosecutor’s office and the court prior to the issuance of the measure of such very serious irregularities – which will give rise to future criminal complaints against those responsible – but both the prosecutor’s office and the Judge ignored it, “Moving forward without further ado in the issuance of the measure to change the date of the elections, which was dictated at the end of the day on 11/23/23, as previously stated.”
