The victim’s lawyer urges Santi Mina’s imprisonment due to “risk of flight”

The private prosecution has requested the Superior Court of Justice of Andalusia (TSJA) the “immediate” entry into prison or, in a subsidiary manner, the precautionary withdrawal of the passport for the soccer player Santi Mina since he considers that his “active search for work outside the country” increases “exponentially the risk of escape” in the face of compliance with the four-year prison sentence to which he is sentenced for sexual abuse.

The document, submitted to the TSJA by the victim’s lawyer on the 7th, states that there is evidence that the “condemned has once again tried to leave the country for apparent work reasons”, but “without informing the court at any time” and “having news of them only and exclusively through the press media”.

He adds that, despite “the defense reiterating the supposed full willingness to justice” on the part of the footballer, he has tried, “as he did last year with his journey to Saudi Arabia” to play on loan for the Al Shabab team, “formalize an employment contract abroad” and it is ugly that “as always” he has omitted any information in this regard.

Sampdoria fans oppose his signing and stop Santi Mina’s arrival in its tracks

The letter, consulted by Europa Press, highlights that the same request was already made to the court on August 9 and that, still unresolved and waiting for the clarification of the TSJA ruling who confirmed the conviction, Santi Mina wanted to sign for the Sampdoria soccer team, in the Italian league.

“His departure from the country has not been frustrated due to the will of the convicted person, but rather the signing has been frustrated due to complaints from the fans of the Italian club. in attention to the background and the crime perpetrated”emphasizes the lawyer Iván Bolaño, who provides reviews from the sports press as a documentary.

For the private prosecution, the footballer “still looking for work fout of the country to have a reason to leave Spain, which “exponentially increases the risk of flight and failure to comply with the sentence imposed.”

Thus, it is of interest to the TSJA that the appearance of the article 505 of the Criminal Procedure Law to decide on entry into prison or, alternatively, the withdrawal of the passport.

Asks “not to continue tolerating favored treatment of the convicted person”

In his first writing, the victim’s lawyer argued that, given that the four-year prison sentence of the Provincial Court of Almería has been ratified by a higher court, entry into “mandatory” prison is possible. He also argued that Mina “does not currently have any work or professional ties that tie him to Spain.” after being fired by RC Celta de Vigo and his “indisputable economic capacity”, which would “enable him to establish himself without problems in any country in the world”.

However, he proposed as subsidiary precautionary measures limiting provisional freedom with the obligation that go to court “weekly” or the withdrawal of the passport “along with the express prohibition of leaving the country” in order, thus, “to no longer tolerate favored and, therefore, discriminatory treatment” with respect to the footballer.

On the other hand, the Andalusian high court must rule on the clarification of the sentence that Santi Mina’s defense has requested to correct “the omissions and defects” in which, in its opinion, the ruling incurs and which it details in its writing in seven points. The accusation has objected as it points out that the Vigo footballer’s lawyer acts with a “obvious, evident, fraudulent and proven dilatory intention” of the execution of the ruling, on which an appeal has been announced to the Supreme Court (TS).

The appeal section of the Civil and Criminal Chamber of the TSJA confirmed in July the sentence of the Almería Court by which it sentenced the footballer Santi Mina to four years in prison for a crime of sexual abuse, although it partially upheld the appeal filed for the defense of the accused and reduces compensation from 50,000 to 25,000 euros for the moral damage caused to the victim.

The sexual abuse that occurred in June 2017 in a van that was parked near a nightclub in Mójacar (Almería)municipality where the footballer was on vacation.
