Urban daspo and oral notice of the questore also for minors who have reached 14 years of age. This is what the decree law to combat youth hardship, educational poverty and juvenile crime provides, being examined today by the pre-Council of Ministers

«The oral warning can also be addressed to persons under the age of eighteen who have completed their fourteenth year of age – reads article 4 of the draft -. For the purposes of the oral notice, the questore convenes the minor, together with at least one parent or other person exercising parental responsibility”.

And if the subject to whom the notice has been served is convicted, even with a non-definitive sentence, for crimes against the person, property or related to weapons or drugs, the questore can propose to the court the prohibition of using «platforms or services specifically indicated computer and telematic systems as well as the ban on owning mobile phones”.

Minor admonished, fine for parents

The minor over the age of 14 may be subjected to the warning procedure by the questore. . A pecuniary administrative sanction ranging from 200 euros to 1,000 euros is applied to those who “were required to supervise the minor or to fulfill educational obligations, unless they prove that they were unable to prevent the fact”.

As for the urban Daspo, «if the persons indicated are dangerous for public safety and are in a municipality other than their places of residence or habitual abode, the questore can order them to leave the territory of the municipality within a term not exceeding forty-eight hours, preventing them from returning, without prior authorisation, for a period of no less than six months and no more than four years”.
