Law Delayed: Judgment in Football Leaks case postponed until September due to incoming amnesty law

Law that determines the pardon of sentences and amnesty for offenses committed by young people regarding WYD only comes into force on September 1st

The reading of the judgment in the Football Leaks case will take place on September 11, given that the proposed amnesty law, which may cover some of the crimes imputed to Rui Pinto, comes into force on the 1st of that month.

Initially scheduled for July 13, the reading of the judgment was postponed by order of the judge, having been scheduled for next Monday, the 31st, in case the law conceived on the occasion of the World Youth Day (WYD) entered into force until 28 of this month, which will not happen.

Francisco Teixeira da Mota, lawyer for Rui Pinto, the main defendant in the process, confirmed this Wednesday to the Lusa agency that the judgment should be known on September 11, since the proposed law, which establishes the pardon of penalties and amnesty for offenses committed by young people as a result of WYD, has already been approved by parliament, but will only come into force on September 1st.

On July 19th, parliament approved the final text of the Government’s bill, to be adopted due to the visit of Pope Francis to Portugal, which covers crimes and offenses committed until June 19th by young people between 16 and 30 years old, determining a pardon one year for all sentences up to eight years imprisonment.

In an order dated July 11, two days before the date initially scheduled for the reading of the judgment, the president of the panel of judges responsible for the Football Leaks case, argues that Rui Pinto, 34 years old, is “covered by the scope of application of the aforementioned Law” for the age he was at the date of the facts imputed in this case.

The creator of Football Leaks was up to 30 years old, the age limit provided for in the proposed law for pardoning sentences and amnesty for crimes and infractions.

“It appears, therefore, that the entry into force of a law is imminent that will conflict with the assessment that must be made of the criminal responsibility of the defendant Rui Pinto in relation to some of the crimes for which he is pronounced in the present case, namely the violation of correspondence and the crime of undue access”, declared Margarida Alves in the dispatch, which scheduled the dates of July 31st or September 11th for the reading of the judgment.

Stressing that “some crimes for which Rui Pinto responds in court will be excluded from such amnesty”, namely extortion (in the attempted form) and those that fall under cybercrime, the magistrate pointed to the possible application of the amnesty to the 68 crimes of undue access and to the 14 of violation of correspondence, which together represent 82 of the 90 crimes imputed to the main accused of the process.

Rui Pinto, 34 years old, was accused of 90 crimes: 68 of undue access, 14 of violation of correspondence, six of illegitimate access, targeting entities such as Sporting, Doyen, the law firm PLMJ, the Portuguese Football Federation ( FPF) and the Attorney General’s Office (PGR), and also for computer sabotage to Sporting’s SAD and for extortion, in the attempted form. This last crime concerns Doyen and was what also led to the pronunciation of lawyer Aníbal Pinto.
