Special Conciliation and Arbitration Boards in CDMX are left without a head – El Sol de México

In full relief of the backlog of 125 thousand labor files, twelve heads of the Special Boards of the Local Board of Conciliation and Arbitration (JLCA) of the CDMX were dismissed.

The foregoing under orders from the Secretary of Labor and Employment Promotion of Mexico City, José Luis Rodríguez Díaz de León.

Despite being responsible for resolving pending lawsuits and one of the objectives of the new labor justice model, “this measure directly violates the Federal Labor Law, regarding the autonomy of the JLCA itself and the immobility of the presidents during the period for which they were appointed, precisely to guarantee their independence as judges”, considered Lauro Sol Orea, president of the JLCA, now dismissed.

He affirmed that this action “means an attack on the new labor justice system and directly harms the workers and their families. And also to the employers because the proceedings of the labor lawsuits that today total more than 125 thousand will be delayed even more”.

The average length of a trial is four years; but with the measures to dismantle the JLCA, the period will double for the worker to have a resolution. “We estimate that it will take at least 12 years to reduce the backlog, which makes this court the most inefficient in the entire country,” he said.

In addition, it represents a serious attack on the rule of law and denotes the ignorance and arbitrariness of the responsible officials of the Government of Mexico City, under the pretext of an alleged lack of budget, he pointed out.

He highlighted that in the past two years, 8 presidents of the JLCA Special Boards left for different reasons. “And yesterday, May 2, 12 more officials were notified of their dismissal through the Labor Bulletin and through personal letters, signed by the CDMX Secretary of Labor and Employment Promotion, José Luis Rodríguez de León.

The now former president of the JLCA Sol Orea also detailed that in the 20 Special Boards office managers who are assistant procedures were appointed, who will now suffer a workload, since they will have to perform multiple functions.
