The Italian Justice asked the Brazilian authorities on Friday that, given the impossibility of extradition, Robinho, serve the sentence in a federal prison in the country
The lawyer of the former Brazilian soccer player “Robinho” affirmed this Saturday that, if the sentence of the Italian Justice that sentenced him to nine years in prison for rape, is approved, the sentence will be served in Brazil.
“The possibility of serving the sentence is given by the international cooperation treaties” with Italy, the former striker’s defense lawyer, Leonardo Pantaleão, declared in an interview with CNN Brazil. On Friday, the Italian Justice formalized a request before the Brazilian authorities so that before the impossibility of extradition Robinho serve the sentence in a federal prison in the country.
“The laws allow the execution of custodial sentences for crimes committed by Brazilians outside the national territory,” said Pantaleão. The judgment of the Italian Justice must be approved by the Superior Court of Justice (STJ)and “when everything is correctly within the Brazilian guidelines, it is a process that should not take long,” he added.

In October, Italy had requested the extradition of the former striker of Real Madrid and Milan after the conviction for the gang rape of a young Albanian woman in Milan (Italy, north), in 2013. Robinho, according to investigations, allegedly made the woman, then 23 years old, drink until she was unconscious to later force her and a group of friends to have sex in the wardrobe of a nightclub without her being able to object.

The events occurred while the footballer had a contract with Milan, a team in which he was for four seasons (2010-2014). The Italian Supreme Court made the nine-year sentence firm decided by the Court of Milan and confirmed by the Court of Appeal.
But the Brazilian constitution does not allow the extradition of its citizens and the sentences, if carried out within the country, cannot exceed thirty years in prison. In addition to Robinho, his friend Ricardo Falco – also sentenced to nine years in prison in Italy – and four other men who were not identified participated in the rape.
