Clash between experts on the understanding and will of Salvatore Buttone, brother of the ras of the Belforte clan and collaborator of justice Bruno Buttone, at the time of the beating of the coachbuilder’s alleged rival in love.
This is what emerged during the hearing celebrated with abbreviated procedure before the investigating judge Pasquale D’Angelo of the court of Santa Maria Capua Vetere where the consultant appointed by the judge the Neapolitan psychiatrist Vincenzo Scarallo affirmed that Salvatore Buttone at the time of the beating which was consumed with the bat baseball to the detriment of the coachbuilder (his alleged rival in love), he was not capable of understanding and wanting. Confirmed by the expert the ability of the defendant to stand trial. Pending the psychiatric report, it emerged that Salvatore Buttone is a crack user to the point of experiencing a regular intake of psychostimulants as well as a psychosis determined by delusional and obsessive jealousy. A social danger from a psychiatric point of view was then found, so much so that hospitalization in a recovery facility for drug addicts was necessary for not less than 18 months.
According to what was established by the consultant of the Deputy Prosecutor Gionata Fiore, Dr. Alfonso Tramontano, Salvatore Buttone is to be credited with drug addiction but he is not to be defined as chronically intoxicated. So for the expert witness, Buttone was capable of understanding at the time of the criminal event for which he ended up on trial. Buttone, driven by a blinding jealousy, went to Marcianise to the body shop where the alleged lover of his wife worked (who filed a civil action represented by the lawyer Andrea Piccolo) who was then in the same building where the couple lived and hit him repeatedly with a baseball bat. His insane suspicions led him to believe that the victim used the hydraulic lift that is used for lifting vehicles to go upstairs or where there was the couple’s apartment precisely to visit the ras’s brother’s wife. All circumstances that later turned out to be the fruit of his imagination.
During the hearing, the defender of Salvatore Buttone, the lawyer Franco Liguori, filed a request for revocation of the precautionary measure on which the investigating judge reserved. The defendant, from the Lanciano district house where he is imprisoned, made spontaneous statements in which he apologized for what had happened, asking forgiveness from the victim and his family. He returns to the courtroom in the middle of February for the prosecution of the Public Prosecutor and the discussions of the lawyers.
