Germán Vaccaro, former president of the CAB, must pay $80,000 for fraudulent administration

He was the highest authority of the Confederation for six years. She managed to access a probation and will never be able to hold a position in the organization again.

The former president of the Argentine Basketball Confederation (CAB), German Vaccaro, he must pay 80 thousand dollars to the CAB and was disqualified for life after the court decided to suspend the trial on trial for a period of three years for the crime of fraudulent administration to the detriment of the organism.

The case was brought forward by Federal Court No. 5 of the Autonomous City of Buenos Aires, for his performance as a former head of the entity for six years. Based on the public complaints made by members of the so-called golden generationIn 2014, the CAB crisis exploded into the air. Vaccaro’s judicial situation was further complicated by his indictment in August 2019.

“Mr. Vaccaro, who accepted his guilt, was imposed the payment of the sum of USD 80,000 to the CAB as reparation for the damage caused. This figure arises from the expertise that appears in the files,” the CAB reported in an official statement this morning.

“Also, will be permanently disqualified from holding positions in the CAB or within the scope of its affiliates,” added the highest governing body of national basketball.

“The CAB promoted the case by becoming a plaintiff in 2016 with the legal sponsorship of Dr. Viviana García Sierra, who remained in that condition until the completion of the criminal process,” the Confederation ruled.

Germán Vaccaro must pay the CAB $80,000 as compensation for the damage caused.

The Argentine Basketball Confederation is currently chaired by Fabián Borro, who prevailed in the last elections on the list of Federico Susbielles.

When the bomb exploded

The former head of the CAB, German Vaccaro, resigned from his position in April 2014 involved in an unsustainable institutional crisis. He had been elected to the presidency in 2008 and re-elected in 2012, having previously been vice president for 16 years.

Although he cited “personal reasons”, it is believed that the pressure from the players of the Major Team and the request for both an internal and external audit was decisive. That scandal led to an investigation and an intervention.

“My resignation was due to family issues, as I said at the time (…) Then events occurred (…) that I am very sorry because they harm the image of our basketball; many linked to me, events that I am not going to clarify at this moment individually, since at the time through the administrative and/or judicial organisms they will be clarified in a timely manner. What I must clarify (is) that I reject all those that exceed the merely administrative, as fallacious and inadmissible,” Vaccaro declared in a letter he sent to the media.

The members of the golden generation They took the floor to denounce a series of irregularities that affected the most important national basketball organization. And the scandal grew even more.

In the preview of the World Cup in Spain, on June 25, 2014, Manu Ginobili, louis scola, German Delfino y Pablo Prigioni (today DT of the Senior Selection), among others, sat down at a press conference at UADE that exposed the authorities while asking for an external and internal audit.

The most successful basketball players in Argentine history shed light on the dark part of a process that led the country to be on the covers of the entire world for the achievements made.

We ask for a profound change, not only personally, but also in the institutional management of the CAB. It’s important, it’s necessary, you have to do it right now. We do not seek personal gain. Our debt is almost unimportant with what we are asking for. The debt exists, they have recognized it and at some point it will be discussed. But it is not the main reason, we fight for 200,000 federated that basketball has, we fight for the small debtors that the CAB has, the people to whom money is owed such as laundry, such as assistance to departments, travel agencies, the employees, the people who work for the team. All of this is more important than our debt, it is not among the priorities, ”said Luis Scola, who months later came to question his participation in the World Cup, something that was finally avoided.

In August of that year, the National Government decided to intervene in the CAB, appointing Federico Susbielles a few days before the start of the World Cup. The audit revealed a public debt of more than 33 million pesoseven with approved positive balances, disappearance of documents, medals, shirts and even the 1950 World Cup champion trophy.

Several years had to pass. These are the times of Justice that seem to run parallel to reality. In August 2019 Germán Vaccaro was prosecuted by the Federal Criminal and Correctional Court No. 5 in charge of Dr. María Eugenia Capuchetti for the crime of unfaithful administration to the detriment of the Argentine Basketball Confederation, aggravated by having also been committed to the detriment of the public administration. In addition, the former head of the CAB was embargoed on his assets for 10 million pesos.

This morning the resolution of the court was that of suspend the trial on trial for a period of three years after Vaccaro agrees to pay 80 thousand dollars to the CAB as compensation for the damage caused and being disqualified from exercising in perpetuity to hold positions in the CAB or its affiliates.

“The suspension of the trial on trial, or probation, is an alternative measure where the judicial process is avoided and the person is subject to not committing a new crime or reparation for damages to the extent offered,” he explained to Clarín the dr. Florence Toretti.

The lawyer adds in her analysis: “In this case, the sentence for which the defendant is accused must not exceed three years to access the trial on trial. It is a criminal figure that allows avoiding trial and decompressing the judicial system to while maintaining firm the principle of innocence on the accused”.
