Basketball Federation management did not find the signatures reliable
For about a month, regardless of whether they play in the leagues and/or fulfill the conditions of membership in the TRNC Basketball Federation, the request for an extraordinary general assembly meeting to be held on the “Election of the Basketball Federation President” by collecting signatures from some clubs has been sent to us by Mr. Eser Taçoy and Mr. delivered by his lawyer.
In accordance with the current basketball statute, the president of the basketball federation and the board of directors are elected every 3 years in accordance with Articles 18(5), 29(2), 30, 32, and 34, as well as the practice that has continued until today. The current management has been in office since 25 July 2020 and will complete his term in one year. Therefore, the present application is meaningless as “the reasons for the request to hold an extraordinary general assembly are not clearly stated” pursuant to Article 19(2) of the statute.
However, considering that only in the 19th article of the Regulation (which was also mentioned in the application), this period was incorrectly written as “two years”, we continued to evaluate the application instead of rejecting it directly.
12(4), (5), (6) and (8). It is essential that clubs or associations that do not pay their annual membership allowances cannot participate in any event organized by the federation, nor can they participate in ordinary/extraordinary/financial committees. As a result of the research we made in the first place, some clubs that did not participate in any events and/or leagues in the last 1 or 2 seasons and/or did not pay their memberships were identified.
However, it has been determined that some of the clubs that signed for the extraordinary general assembly have signed through the representative, and naturally, in accordance with Article 24(6) of the statute, “if the representative is someone other than the chairman who has been notified to the federation, the club or association that he represents and the authority bearing the signature of the chairman of the board of directors. The condition of presenting the document” was questioned.
These documents were requested from Mr. Eser Taçoyun’s lawyer and Lal Kaner.
However, we were informed in writing by Mr. Eser Taçoy that one of the signatories withdrew their signature during the notification made to us.
In the coming days, we will check whether the 2/3 quorum required for an extraordinary general assembly meeting can be achieved, together with the more detailed research we will do and the submission of the requested documents to us.
