The controversy surrounding the board of directors and members of the Coquimbo Tennis Club

The conflict between the administration of the Coquimbo Tennis Club, with an important group of partners, continues to grow, to such an extent that in the second summons of the assembly called for Monday night, those present made a “vote of no confidence” at the current board of directors, proceeding to elect a new board of directors that will seek to govern the club’s destinies in order not to lose the physical space that has been provided on loan to National Assets in the Peñuelas sector.

And he is one of the most outstanding players that the club has had in the last 25 years, the engineer Christian Leyton, who, according to him, leads “more than 35 partners”, in order to demand that “a new board of directors be elected “, Product of” a series of irregularities “in which the current board of directors has incurred

Leyton explained to El Día that for them it is “strange” that at this time the board seeks to regularize before National Assets the issue of paddle tennis courts that are on the ground. “In the last meeting (first summons), the same president arrived with a letter where the courts are transferred to the private paddle tennis players for 36 additional months with an agreement that does not benefit the club financially at all, and that was taken without consulting him. nobody, ”he says.

Leyton claims to represent a good part of the partners in opposing and censuring the current board of directors, so “our position is to veto the current board, based on 4 key points related to the lack of transparency, the non-realization of assemblies and they have not shown the finances of the club; He sublet a piece of land to a private party, on a piece of land that was assigned by Bienes Nacionales, they have been profiting for two years, which is the cause of the loss of the loan of the fields; various domestic issues, including bad relations with workers and firms that do not correspond in the minutes of the tennis club ”.

Censorship and choice

The professional specifies that the concern they currently have is valid in the face of the anomalies they denounce, “there are legal breaches of the sports law and supreme decree 59 that the regulations and the attachment to the loan we have, so our concern it is taking care of the tennis club ”, he adds.

He insists that it was impossible to elect those directors that the board demanded, a matter that was table by table. “We refused, without having an electoral commission, we presented a letter and they left the meeting saying that this was not on the table. As it was the second call, we, based on the statutes and the law, voted for the censorship of the board of directors and we elected a provisional directive that we entered the IND, so we are waiting for their response to validate this, which yes, that the current directive, which is supposedly the directive, is not in force as the Coquimbo Tennis Club ”.

Along with Leyton, they also elected Reinaldo Araya, Paulo Galarce, Patricio Muñoz and Julio Araya. “Our intention is that nothing is left in the air and the first thing we will do, democratically, will be to call elections, what we want is to formalize and fix the issue,” he emphasizes.

Faced with the statements of President Yáñez, who does not know the process they carried out for not being

In the table, he does not pay much attention, “the important thing is that he is no longer president of the club, the majority of the members decided to seek a new path, of clarity, with democratic elections and we hope that he is a good person and can abide by what is legal, give us the club and its resources and not force us to continue with legal issues. The IND’s response before 30 (tomorrow), is to validate this new directory, since the current one expired, apart from the fact that the possibility of reelection is not there either because, according to the Sports Law, they are every 2 years and Yáñez is president for a long time ”.

The paddle

Faced with the position shown in the Ministry of National Assets to change the non-profit loan to an onerous one, Leyton assures that this must be seen. “You have to ask the partners, first you have to call an assembly and propose a solution, you have to talk to the paddle tennis people who are in an irregular situation, see if the courts are ours or theirs, how much more time they have left and see if the club is interested in subletting that activity to someone, since perhaps they are interested in managing it, since that could become a swimming, tennis and other use complex, which would be very important, “he projected.

He adds that “the main thing for us is not to make an onerous lease, that is like a second stage, the first thing is to comply and see the possibility of whether modifications can be made to the project, to be able to enter it and be to the letter with what says the loan “.

Asked if that would mean eliminating paddle tennis, one of the most popular sports in the country precisely at the time of the pandemic, he reiterated that today, “they cannot work, we as a tennis club are subsidizing them, we are letting them work without a patent and that cannot be. There are pending audits, perhaps due to a pandemic, the dates that have allowed them to continue operating, but they are under our premises, clearly it is the responsibility of the Coquimbo Tennis Club to allow that, since neither the paddle nor the rental is established in the loan. the loan says tennis and swimming ”.

El Día tried to communicate with the administrators of the paddle courts, proving unsuccessful to have a statement in front of this instance.

Answer from Yáñez

Omar Yáñez, meanwhile, insists that what the partners have done at the end of the assembly is not valid for them, since the election of that directive led by Christian Leyton was not on the table.

The manager indicated that in that second assembly of partners held on December 27, the table should deal with the financial account for the 2021 period, the election of two partners to fill the position of secretary and director, and the election of the account review committee. , meeting held with 17 qualified partners plus 1 as a listener.

In the first part of the meeting, one of the partners disclosed the procedures carried out by the board of directors before the Ministry of National Assets in relation to the modification of the loan of free use to use for consideration of the Coquimbo Tennis Club and in this way regularize the situation with the paddle.

Faced with the words of Leyton, who questioned the legitimacy of the board of directors that has an expired mandate, Yáñez clarifies that “this situation is not such since what IND asks is that they complete the directory according to what is indicated in the Club’s Bylaws. and that there are 5 directors ”.

It adds that it was not possible either to elect the two missing directors to be able to complete the procedures before National Assets due to the agreement of the extension of the loan, “it was not favorable to the partners either, the current directory was not allowed to complete the procedures in said public department and hence calling for general elections ”.

At the time and in the face of the criticism he has received for the operation of the paddle not established in the concession of National Assets, Yáñez stressed that “the modification of the concession is being processed before the Ministry of National Assets and thus be able to regularize this situation, that it was even declared in their midst by the Minister of National Assets a few days ago, but for this the directory must be completed so they must choose the 2 missing positions “.

IND actions

Although the Sports Institute (IND) did not deliver a statement, it is public knowledge that two weeks ago they officiated at the Coquimbo Tennis Club, the Supervigilance process of decree 59 of sports organizations, so the club must respond at the request of the presentation of the minute books, partners, assemblies, accounting books, balance sheets and reports, which until yesterday had not been sent.

Omar Yáñez, acknowledged that on Thursday, tomorrow “they will be sent first thing in the morning.”
