Pieces of extra-country life staged in the last bars of a trial which saw its epilogue at the Antivigilia with the conviction of a 48-year-old man from Viggiù for “arbitrary exercise of one’s own reasons“(Attempted), a crime derecognised by much heavier charges, those of attempted extortion and aggravated injuries, deviated from the defense of the lawyer Andrea Boni after the requests for sentence made by the public prosecutor Federica Recanello only for the injuries, aggravated according to the reconstruction of the facts by the use of an improper weapon, a baseball bat.
The facts can be traced back to what happened on the evening of 3 December 2017 in Viggiù in the home of a contemporary of the accused who lives with his parents: a life marked by some vice without always having the financial coverage.
So it’s up to the friends of the bar to stretch something to get to “50” for the “pippata”, the shot of coke started for fun with friends has become a vice, as well as the 30 euros pocketed one evening with the promise to give them back a few days later.
But the days turn into weeks and the euros rise to 500. So today’s defendant who wanted to get the money back was accused of breaking into the victim’s home armed with a baseball bat and having hit the boy several times inside his house.
A reconstruction finished in the stamped papers and on the tables of justice but to which the judges (president of the College Andrea Crema) did not believe, condemning the accused, yes, but for a much less serious crime.
That is, the crime committed by whoever, in order to exercise a claimed right, while being able to appeal to the judge, arbitrarily makes himself right through violence against things or using violence or threats to people: di three months was the sentence, plus court costs.
But let’s go in order. The debt between the two had existed for some time and the accused repeatedly asked to get back the total sum. The debtor promises, but calls are not found or not answered.

No sooner said than done. On the evening of early December four years ago here comes the showdown: the accused rings the door and the 48-year-old with whom he opens the door. an animated discussion begins to attract the attention of the neighbor of the house that arrives on the scene but does not see any club, nor a violent quarrel: only loud phrases, some shouted blasphemy and nothing more.
In the late evening, however, the debtor goes to the emergency room. He says he has been beaten and is awarded a seven-day prognosis: with the PS doctor’s card he goes to the carabinieri and denounces the attack. The other person involved in the dispute does the same, always explaining what happened in a report to the military.
Criminal action begins and during the trial some witnesses are heard who weaken the position of the aggressor who will therefore only have to answer for excessive demands for an unpaid debt: the baseball bat, for the record, no one has seen. Sentence suspended with parole.
